I found this site very helpful and informational. I came in the US on K1 visa. We got married after two weeks from my arrival in the US. We hired a lawyer and paid $2,000.00 to file the AOS. However, we are not happy with their service. The lawyer we hired had caused us a long delay. We completed the paperworks and provided the requirements they instructed us. We submitted them to our lawyer a week after we got married. All they have to do is go over the paperworks we completed and mail the forms. We waited at least 5 weeks to give us a call and inform us that the forms are ready for signing before they will send them out. But they never called until we bugged them. The secretary reassured me that I won't be out of status even filing after the expiry of I-94. The lawyer was always difficult to reach. She was always out of the office and she never returned our call. On the other hand, the secretary is inefficient and not very helpful. My husband and I expressed our frustrations at some point about the delay. Eventually the secretary set an appointment for us to come to the office and sign the papers. However, the lawyer was not there It took them another 2 weeks until the lawyer signed and the mailed the forms.The secretary claimed today that they were mailed yesterday. I feel hesitant to trust them if they already did mail the forms after a long delay.

My I-94 will expire on Sept.28. My question is, will I experience a problem if the AOS will be filed and sent after the expiry of I-94? Will I be out of status?

NOpe so long as you got married within the 90 days upon entry. I applied AOS after myI-94 expires. I would just like to say sorry that you had this experience with the lawyer paying $2000 and still delaying things!!! :angry: I will be mad too if we paid $2000 and they will delay everything thats why we cross our fingers and do it on our own.Good luck :thumbs:

No, as long as you got married in the 90 day window period you're fine.

No. You will simply experience the delay you already know about and the associated frustration. You are not required to file AOS before I-94 expiry but you are required to marry. You have, so you might as well relax and enjoy your life together as you wait and curse your attorney.
