Will my K1 application be affected?

Hello, this thing has been bothering me. I am all for the truth and to make a stand for our relationship.

My family is in the US since 1998 under F4 classification and are now US permanent residents. One of my sisters went there on a working visa that has expired but still residing there. She now got a pending petition filed by my parents.

In case they make a family background check, I am anticipating for questions to arise during the interview regarding this matter. Does anyone here have knowledge on how it will affect our application? What's the best thing for me to do?

Hi Marie!

My father is a US citizen, he is in the US for more than 25 years now...I have some relatives, brothers and sisters that are US citizens too and when my mom went to the US in 2002 but when they applied for a citizenship she was denied for some reason so my mom is in the Philippines now...but they did not question me about that. sooo..I dont think it will affect your K1 visa application..in an event that they will question you so I suggest that be ready and God Bless! :star:

My husband has a sister and an ex brother in law here. The reality is that the ex brother in law was from a different sister, but when they questioned him at the consulate they thought that these 2 were married at one time and now divorced. It turned ugly after they questioned him about the divorce. He tried to tell them that the sister is still married, but it was too late and the damage was done. They denied his visa, and sent the application back to the USCIS for revokation. We fought them and because I had proof that his sister was still married I won. It should not have any bearing on your case, but it potentionally might. They assumed that she married this man to acquire a visa, and then they assumed that she paid me to marry her brother. Stupid waste of 2 years.

If we were you I would be prepared to answer the question honestly, and I would have a copy of the pending petition. They might ask about the contact your SO has had with your family. I would be prepared to show proof of when and how you met as well as proof of the first time your SO met and talked with your family here.

If we were you I would be prepared to answer the question honestly

I'm with you on that one. It's best to be honest from the very beginning if they bring it up because they are so good at cross examining the person they're interviewing that they will catch you lying at some point. And in all honesty, any family illegal status here has nothing to do with your SO filing a petition for you. It's not like you're forever responsible for their actions and as far as anything goes, you'll be living your life with your fiancée and they're living their lives somewhere else.

Thank you. As you can see our timeline it took us almost a year before meeting each other personally, we wanted to be sure of our feelings as true and not this relationship a failure again. I am bringing with me proofs of my fiance's 4x visits to my family and a notice of the filed petition and I don't care bringing a box of proofs to prove our relationship is genuine :P and YES be prepared to answer with all honesty.

You know that is how I viewed it too. It was about me and my husband. Even if my sister in law was here illegally what does that have to do with us? Unfortunately they didn't see it that way.

If you go in prepared to tell them about the status, with plenty of proof, you should be good to go.
