Hi, I was finishing up my petition for my fiancee's visa but now I'm uncertain what to do with all of these changes that are going on. It seems like there is a major backlog now and new forms still aren't available. Should I proceed with everything that I have and send it in? I'm debating whether or not to just get married and file the K-3 now because that seems a lot simpler. I am visiting her again in about a month and I know others that are in Korea are getting K-3's pretty quick.

Does anyone have any advice?

Calling USCIS and ask would be a smart thing to do, but at this stage we don´t know what they know about this.

But I would still recommend you to give them a call at 1 800 375 52 83

Spousal petition could possibly be a good option right now. At least those petitions weren't affected by the recall and the NBC is showing as processing petitions with a later date then they are at service centers for the I-129F for fiance. Its worth a shot IMO. Others may disagree.

I am on hold for the USCIS right now and the estimated wait time is 35-40 minutes. I've called them several times in the past and the wait time was never more than 10 min. I'm sure they are answering a lot of redundant questions.

Either way apparently there´s not new form as of yet, so you either send your petition and expect an RFE down the road (if we all get them) or you wait to see what happens. Maybe you can wait this month to see if K1 is still the better option, if not when you go down there you get married and file for K3.

September 15 - 2005: NOA1

October: Waiting

November: Waiting

December: In Security checks

January 2006: Waiting

February: Waiting..Contacted Congress

March 4th: APPROVED

March 17th: NVC posted file to London

March 20th: London Receives file

March 29th: Receive package 3

April 13th: London Receives package

April 19th: Medical - June 13th: INTERVIEW......APPROVED!!!!

June 20th: ARRIVE IN USA

Time taken for whole process 9 Months

AOS

October: 13th: Sent off AOS Package

November 3rd: NOA1

November 14th: Snail mail ~ NOA1 ~ Case moved to the CSC for faster processing.

November 14th : CSC has petition for me and my daughter.

December 14th: Biometrics completed.

January 17th: APPROVED AOS!

January 22nd: Green card arrives in the mail:))

Time taken for AOS - 3.5 Months

Finished for 2 years.

So to avoid more redundant questions, please ask them wether they have already started working on sending the new questionaires to the recalled petitioners or if they are still waiting for new instructions and holding evryone, including the recalled cases.

That was pretty useless. Again, I got the "no information" line from them. He also told me that they weren't sure how this was going to affect them or what would be needed. No mention of new questionnaires or anything. He just told me to submit my package as I normally would have. What a waste.

They always try to give the latest case dates but I told him I know about those, including the backup on dates from some of the service centers. I think I'll just submit the K-1 still since I don't have time to have my fiancee get all the documents she needs to get married next month before my trip. I'll just have to hope for the best. Getting married in an overseas location is a lot easier if you aren't in the military.

Honestly, given that my fiance's projected interview date will be held in "a few months," I kind of regret not getting married in January and filing for the K-3 then instead of the K-1. And since you have the option sitting before you, I think the K-3 might have become the better choice.

If I were you, knowing what I know now and in light of the IMBRA law, I'd get married asap and do the K-3.

10/30/2006: AOS approved without interview, greencard will be sent! :)

11/04/2006: Greencard arrives in the mail! :-D

... No more USCIS for two whole years! ...

Little Missy Foo at USCIS was also a b***h even though I was killing her with kindness. When I said the State Dept. www said to call CIS for info on IMBRA she said "Once an application is approved we have no..." Same ####### different ....... recording? I wonder........

OK, I'm venting. After weeks/hours of trying to find someone in our government who has a clue, after realizing our government can't even handle a law change and produce a current and proper form in a timely and professional manner, my conclusion is we are the country of incompetents!

I say get your flag! Call your congressional representatives! Go into the streets and protest! Yell! Scream! Demand! Get a translator!

Oops! Venting again.

But seriously, what can we do as law-abiding, tax-paying citizens? There has to be something!!??
