Hi,

I have some questions.

I am a Filipina, and I am still here in the Philippines.

My US VISA will be expired this December 2008. I can't come to the United States because of the following reasons:

1. My husband is still in contract with the US Military. He is based in South Korea. That will be until June 2009.

2. I'm pregnant.

Questions:

1. I am under CR1 or Conditional Spouse, how can we remove the conditional status, can it be done here in the Philippines? Please leme know where to find information. Our second anniversary will be on February 2009.

2. When my US VISA expires this December, do we have to redo the process? Or shall it just be renewed?

I heard that those in the military can get the greencard process done without being physically in the US. Where this can be done?

3. My baby after he is born will be an automatic US citizen...do we need to apply? Where?

I know that we should research or find the answers for ourselves but I'm lost of keywords, I just wanted to hear some personal accounts and expertise regarding this matters. Thanks a lot!!!!!

I don't know all the answers for sure... but if your USC spouse is stationed overseas, they have exemptions for you... it should be on the form i think or in the instructions for the form. Both of you have to file the form together, and it's advisable you stay together also physically... so coming here alone may not be great since that means if they need an interview you will be apart.

Your baby will be a citizen, but your husband must file the appropriate paperwork at the nearest embassy. He's the citizen, so he should technically do this, but I guess if you have all the paperwork they may let you do it too.

Being a citizen when born overseas is semi-automatic as long as the person do the right things.

U.S. citizen parents of children born abroad may file a N-600 Application for Certificate of Citizenship.

I believe your husband filed Petition for Alien Spouse, (I-130).. Your visa get approved and you have to go to the US within 6 months to enter to the US Port of Entry and do your biometrics and everything.. You have to bring the envelope that was given to you by the US Embassy (philippines)> This envelope should not be open till the US Port of Entry.. The Officer is the only person that can open this envelope..

You are totally getting for something you dont need to stress about YET..

The only thing you need to worry is that if you did not enter the US, your visa will be revoke and you will have to file another Petition again and explain your situation, this will take time because of your first situation.. You need to go to the US before December. I believe your husband has an immediate family that can help you while you are there.. Once you entered the US and did all the biometrics in the US port of entry, after2 weeks I guess you will receive your conditional greencard by mail as well as your SSN card.. if you will be living in the Philippines after you received your greencard, you need to at least go back to the US after 10 months to meet the physical residence requirement..

For this question:

Just think about this later after you enter the US and received your greencard. But let me tell you about information for US Citizen whose wife is joining with them overseas, it is true that you can process your Naturalization without living in the US.. But you have to have a greencard/a resident whether conditional or permanent one.. Article 319b (INA) applies also to civilian who is engaging to US company overseas, military or non profitable organization(Please research 319b online for better understanding...) In order for your application to be approved for Naturalization.. your husband should have at least 1 year remaining contract overseas and you will join him once he get deployed.

This will totally confused you, but I would advise to just focus first on the 1st step before jumping to the last step..

(I was a (1yr and 6 months conditional resident, when I got naturalized.)

The answer is: it depends... if you gave birth in the Philippines, you have to report the birth in the US Embassy, please refer to local US Embassy on how to do a report on birth abroad, once you did that you can apply for his passport at the same time. If you give birth in the US, of course your child will be automatic US citizen..

hi! tell your husband to inquire your case at their legal office or immigration or in the family center or personnel office. there is assigned office for this cases, i just forgot what office.

or why can't you enter US before your visa expires, you can stay in a relative or friend, or your husband can file a leave from work so he can accompany you to US.
