most all of us here are doing things the right and legal way, and we can do very little other than wait for our approvals of petition and visa's. sounds like he has been here a long time since his visa expired. and without money for a very good attorney your chances of keeping him here are slim to non, thats the reality of it...

Because if you are, I wonder how you can come to that conclusion with the little bit of information we have been given.

Well.... his visa is expired. I mean, it shouldn't have happened, he should have just gone to the doctor at the time so he would have gotten an excuse and not failed his last semester. I didn't know him back then and I didn't realize it was expired when we first started dating, but have known it now for over a year. I think the policy is silly, you should be able to renew in the US if something like that happens (like you could before 9/11) but yes, we are sort of going about this the, er, wrong way. But I have no choice about it, and I personally haven't done anything wrong.

No, he was doing everything the right way, starting with overstaying his visa. :wacko: That's why he's in immigration jail, for following the rules {insert sarcasm}

With the little info we have been given, I think its clear that he's overstayed and that is illegal. Being in immigration jail with deportation proceedings in process, means his chances for staying here really are slim to none.

NO I'm not implying at all... I am making a statement !! he overstayed his visa by years !!! and that is illegal. so I'm surprised you didn't catch that with all the info provided !! so he got caught and now she ask the good and legal members of VJ for help. so whats new?

if he can request for volunteer deportation will be better, than you can married him and start the process, in that case he will need the waiver I-601, if he is formally deported/removed from the U.S also will need I- 601 for more information in waivers go to Immigrate2US.net it is alot information there and also you can post your case

You cannot possibly know the entire details of this case. You don't know anything more than what has been told to us by the OP.

Just because you have to wait doesn't mean that if there are LEGAL avenues available to the OP's boyfriend to stay in the US that those avenues are wrong. The guy is in jail right now. Isn't that enough for you? Or are you only satisfied if all couples are separated?

I've seen plenty people go to jail for illegal acts and the first thing they do is ask for help. if your going to take big chances in life, you better be ready for big consequences. and getting married to avoid deportation is not legal. so I don't know what your thinking about. I have my doubts if we read the same post !!!

i see u got ur I129 approved in 15 days. so what would u know about walking a mile in my shoes. She has told us plenty to make a judgement. and I believe (and obviosly so do others) that my opinion is correct and fair. I'm entitled to my opinion and if you don't like it, tough ####### for you. I've seen plenty people go to jail for illegal acts and the first thing they do is ask for help. if your going to take big chances in life, you better be ready for big consequences. and getting married to avoid deportation is not legal. so I don't know what your thinking about. I have my doubts if we read the same post !!!

Yep. 15 days. It's almost a VJ record. So was the visa approval - it was only like - wow, 106 days. I'm sure yours will take much longer. After all, you're a persecuted white man married to a poor poor pinay.

I wouldn't want to walk a mile in your shoes, buster. Because that would mean I would have to step through your $hitty attitude every day.

Don't talk to me about decency. You're the one who started it, dragging my timeline into it. And I brought up the nationality for a very good reason, of which you would already be aware if you knew jack-squat about immigration. The Manila consulate processes more K1 and K3 visas than any in the world. And the rate for visa fraud is astronomical. If for NO OTHER REASON than that, you can expect YOUR process to take longer than many others.

The OP has said nothing about doing anything illegally. She is making an inquiry. And where in the world did you get the information that she had no money? With responses like yours she'll be run off the board before getting ANY information. Honestly. Get a clue.
