Should I or my Parents bring my younger Brother to USA?

Hi,

I'm just a new USC last week. I still have my parents and younger brother 18 years old (just graduated High School) in Vietnam.

Should I apply I-130 for him at same time as my parents, or should my parents apply for him as their son once they come to USA and become US Citizenship?

I heard if I apply for him, he still has to wait 10+ years due to sibbling sponsorship. But if my parents come to USA and become US Citizens 5 yrs later, they can apply for him as their son and he has to wait just 1-2 yrs after that for a total of about 7 yrs. Some advised I should apply for him and my parents later also apply for him, and whatever his chance comes first. But some also advised "don't do both because it may cause confusion at the US and may delay the process".

Please advise. Thank you very much.

PS: I posted a related question last week and some advised my parents should say noone is going to take care of him so he may have a chance to come to USA with my parents, and some said he has to stay and wait a long time because of F4 status.

The fastest way to bring your brother to the US is first petition your parents which generally takes about a 1 year or 2. Then once they are here they should petition your brother as their son. That takes about 2 years.

Don't let the choices chose you, chose the choices that you want.

Incorrect. Petitioning the brother now would expedite his case. If you were to wait for the parents to become eligible to petition him, there's a greater potential that the brother could age out.

R U sure that thre is an age out for an I-130 for an adult son??? I think the only requirement would be that he remain single.;

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Sorry, yes, as a sibling beneficiary the issue is whether "married" or not. I wasn't exactly precise. I believe, if the brother is petitioned by its parents, as LPRs, age becomes an issue.

Thanks for those that correct me. I was mis-informed by the USCIS.

From the I-130 Instructions:

When Will a Visa Become Available?

When a petition is approved for the husband, wife, parent, or unmarried minor child of a United States citizen, these persons are classified as immmediate relatives. They do not have to wait for a visa number because immediate relatives are not subject to the immigrant visa limit.

For alien relatives in preference categories, a limited number of immigrant visas are issued each year. The visas are processed in the order in which the petitions are properly filed and accepted by USCIS. To be considered properly filed, a petition must be fully completed and signed, and the fee must be paid.

Since the brother is 18, I don't believe he would be classed as a minor. By the time you could get the parents here and USC, definately not. Therefore, file now and hope for the best. Sorry...

1) When my parents arrive in the USA, how long/soon can they apply for a Green Card (to be a Permanent Resident)? And how long would they become a Permanent Resident?

2) If they become Permanent Resident, the law said they could file for their unmarried son (my brother) at that time, correct?

1. When they arrive, and they would stay a PR as long as they among other things maintained residency.
