I need to ask this but don't know if It is in the correct forum. My husband (north africa benificiary) has been recieving mail from Co's in Canada about employment ops. I (petitioner) reside in USA. Is it possible for him to intend to leave me once he gets his US visa and relocate alone to canada? I just domnot know why he would seek work ops there and not here unless he is considering leaving me.

canadian immigration isn't too much different than US. some parts are but he'd need a work visa to just go work there. check out their site. they explain things a lot better than the US http://www.cic.gc.ca/english/index.asp

thanks wowswift. According to the link (unless I read incorrectly) he can do that very thing. WOW. from the USA with a greencard visa it is possible for someone to go to canada for work and residency. This is like a very bad dream...but better now than later I suppose.

well he can, but im not sure how easy it is. The US does work visa's too. it really depends on what he's applying to work for i suppose and where too. i did read your other story, i really hope you find the truth. and i hope he gives it to you, either way, out of respect for you. you at least deserve that.

Once he receive his greencard, he can work in Canada... I dont know if what kind of Visa you filed for him though.. If it is a K3 vISA, he may need to file Adjustment of Status of Advance Parole..(look for the complete information online) But if it is a CR1 vISA, no need to file Adjustment of Status, but he need to get his SSN first prior to his leaving..

He can work in Canada, provided that he will return back to the US every 10-11 months to meet the physical presence requirement as an immigrant..

Canada and the USA are free countries so if Canada will give him work authorization, he is free to go there and work. Of course, he would not retain his US permanent resident status while doing so. Your relationship is another issue altogether.

Just because someone has a greencard, it does not mean they can go and work in Canada.

He would have to obtain a work visa to work in Canada. In my understanding, Canada has similar policies to the US when it comes to foreign workers. You have to have an employer who needs you, or you have to have a special occupation which would make you an essential worker in Canada. Canada, like the US, is not really in need of workers so he would essentially have to make it happen for himself on his own. He has to be educated, be a skilled worker, will be accessed on his English and French, etc. Canada works on a point based system of immigration in which he would have to attain a certain amount of points.

Not to mention he would have to have money in the first place to support himself.

I really wouldn't worry about this.

I have just one question and comment, are these unsolicited letters offering employment? There are quite a few employment scams targeting immigrants that originate or claim to originate from Canadian companies. In particular, emails claiming to be from hotels or cruise companies. Any company that wants you to send money for placement should be regarded as suspicious. If something sounds too good to be true, it usually is...

On the other hand, if they are responses from companies that he has contacted, in his field, that is another story!

One point to consider:

If your husband has a CR-1 visa, it is CONDITIONAL. It can be revoked.

My husband (CR-1 visa) and I (American citizen/petitioner) were considering moving outside US if he received a job offer. But a lawyer I consulted said that for my husband to retain his visa, he has to show proof of being DOMICILED in USA. That too much time spent outside of USA during the first two years of his conditional status could lead to revocation.

DOMICILE - meaning, living and working here in USA (financial, residential, etc).

Many greencard seekers think that once they get a greencard, they can hop on a plane back to their country. Thinking they can come and go as they please to USA. However, these people can be denied entry into USA by the Customs Border Patrol Agent at the airport if they don't show they've maintained a presence here in USA.
