Which way to go?

I am a Canadian Citizen living in the US on an H1B visa. I have been out of work since January 06, but the visa expires in 11-07. I think that as a Canadian, I am legal here for 6 months. This means that on June 30, if I haven't found another job, I must go back. Right? I have lived on and off in the states on TN work visas and got my Bachelors degree in Daytona Beach, FL.

I now own a home with my boyfriend of 2 1/2 years. We talked about marriage prior to me loosing my job, and now we are seriously considering it. But what's the best way to go? K-3, CR-1??? Will I have to go back to Canada after we get married? Will I be able to work? How fast "could" I get my "Green Card"?

I read many of the postings, but found nothing that matched my situation. Can anyone help me figure out what the best, and fastest route would be for me?

I already have a SSN...obviously.

The best would be probably a K1. You can come to the United States and wait there as long as you don't violate any other law and as long as you leave the country when necessary or when your status expires.

I went through my interview today. We filed the K1-application in December. I entered December 29th, left March 26th, reentered April 9th and left last thursday to be in germany for the interview.

As long as you can show them that you are going to leave the country as told and necessary I think no one will turn you down.

It doesn't matter if you have a SSN. It is your status that matters.

I went through my interview today. We filed the K1-application in December. I entered December 29th, left March 26th, reentered April 9th and left last thursday to be in germany for the interview.

I agree. The K1 Visa is the best option

As you legally entered the US, you are probably eligable for adjusting status in the US. Someone else can probably tell you more. If you can do AOS you don't have to return to Canada but can stay in the US

Thanks for the reply stinger157, I was hoping I would be able to get a visa that would allow me to stay in the US. I've been living here for 4 years and have an established "life". I wouldn't mind going back for the interview and what not, but going back for an extended period of time would be a problem.

Thanks so much. After all of my reading, I think that it would be the best way. I just wonder how long it would take for me to be able to work. Do you have an idea?

I would consider making an infopass appointment to actually check with your local office, but I believe that you can get married in the US and adjust status, provided that you enterred legally, which it appears you have. You may want to check quickly however so that you do not end up with an overstay. Good luck! Once you file for AOS, you are allowed to stay to wait for your appointment.

If you were inspected and granted entry you can adjust status. As you came in on a H1B visa, this would I assume apply to you. Much is overlooked when one is married to a USC as far as overstays etc. (see above link) Also read HERE re H1B visas

Would anyone happen to know what the A# would be? I have my I-94#, is that it?

NOt it.........when i entered on a K3 they wrote my A# on the back of my I-94 also on a page of my passport!!,i hope this is a help :thumbs:

Can anyone tell me what NOA stands for? I have been searching for the meaning of all the acronyms used on the site with no luck.
