Hello fellow petitioners!

I am preparing my wife's AOS documents but I may be missing the I-94 form. When we checked through customs with my wife's (she was them my fiance) K1 visa, the customs officer did not give us a I-94 form, he only stapled an I-94 stub to a page on her passport, next to her K1 visa page. Is this what is needed to submit for an AOS or is there a different form for the I-94 required? If so, how do I get it since customs has it?

That stub that is stapled in your wife's passport is the I-94 form. It has a perforated edge that leaves only a small strip behind where the staple is when it is removed. I submitted mine with the AOS application, although I understand others have just sent in a copy. As I am still waiting for my AOS interview I don't know if that is a good thing or not. The I-94 expires 90 days after your wife is admitted. What I would do if you haven't done it already is keep the I-94 in the passport until she has applied for both her SSN and her driver's license, as long as it is before the I-94 expires. Photocopies don't work for either of those:-).

Good luck - and take a number of photocopies of the I-94 before you send it in if you send in the original - you may need them again if the adjudication process takes some time.

The stub is the I-94. You will see on the back an A number that is stamped, ours was in red. We kept the stub in my wife's passport, and just sent a copy of the stub with the I-495 AOS application. At our AOS interview last week the case officer removed the I-94 stub, and replaced it with a 551 stamp noting conditional permanent residency in the passport as a temporary measure until the green card arrives.
