MY FRIEND HAS A PROBLEM HER PAPERWORK WAS DENIED THE 1ST TIME SHE TRIED TO ADJUST FROM HER K1(SHE DID THE PAPERWORK HER SELF) NOW SHE IS REAPLLYING AGAIN HER LAWYER SAID SHE NEEDS TO DUE ANOTHER i130 IS THIS CORRECT SINCE SHE CAME IN ON AN I130 IT HAS BEEN ALMOST 2YRS

first of all, ur post is not very clear. was she denied for the AOS and if she was, what was the reason for it? if you can add more about the denial, maybe some of us here came help you.

I AM PRETTY SURE THE 1ST TIME WAS DUE TO NOT SENDING IN ALL THE CORRECT PAPERWORK. SO SHE GOT NERVOUS AND HIRED A LAWYER FOR THE 2ND TIME HER AND HER HUSBANDS ENGLISH IS NOT GOOD

A k-1 doesn't need an I-130 if they married in the 90 days.

she came to the usa 2 yrs ago from cambodia

she got married withen the 90 days

she filed her paperwork, paperwork done by friend, USCIS returned to her saying she had written the wrong A#.

she makes infopass appointment and they tell her she needs to redue all the paperwork again, now she hires a lawyer and the lawyer says she needs another I130(she filed in jan.) she gets a letter today on her case. 1st letter says she needs to submit origanel marriage cert. and the letter for the i130 says she needs passport pictures of her husband and marriage cert.(lawyer checked all paperwork the 1st time she would have these letters) my ? is due you need another I130

because i have done all my paperwork for my wife through the help of vj. and from k1 process. and now 11 months later we are getting rdy for are green card interview. but my friend is haveing a problem and this is a good place for info plus my friend has payed the lawyer close to$3000 dollars to due her adjustment and to have the uscis send you a letter saying you are still missing things the lawyer should have realized before he sent her info in..

If all she needed was passport pictures and a certified marriage license wouldn't that be considered an RFE rather than a denial.. I thought you would be denied after the interview?

If this lawyer is really screwing up, I think they need to get a new one. Sad that they lost out on lots of $$

Timeline

The only time I have heard of a K1 needing the I 130 is if they let the 90 days expire on the visa before marriage. She paid the lawyer some serious cash. Hopefully he / she knows the deal.

VJ can check the lawyer if you think he / she is incompetent but you haven't given much to work with here. If your friend couldn't even get here A number straight then she probably needs a good attorney. The USCIS does not need any certified copies of marriage liscenses. They only need a copy that looks legal.

16 Nov 29 Nov Notice date

3 Dec Received NOA 1

3 Jan 05 Please I just want to be touched

3 may 05 NOA2 E mail notification

7 May 05 Mail NOA2

11 May 05 sent petition to Bogota

18 May Packet 3 arrived

19 May Checklist taken to consulate

31 May Packet 4 delivered

29 June visa granted

1 July Visa delivered

Sometime in July Lucero came to US

13 Sept 05 Married

1 Nov 05 -USCIS recieved 485 and EAD

13 December RFE stupid things I should have included Returned very quickly

27 March received bio letter for New Orleans

7 Apr_06 Bio done in New Orleans

20 April 06 Touched on all applications

21 April Email received EAD approved

27 Apr Received EAD card

30 May 2006 Received appointment letter for JaX on 13 July 2006

13 July Interview successful approved

20 July Received green card

30 June 08 Sent I751 to remove conditions

25 July 08 Application returned erroneously incorrect fee

27 July mailed new application with separate checks

15 Sept 08 Application returned erroneously K2 not within 90 day timeframe

17 Sept Mailed 3rd application with mountains of proof of error copied Senator Mel Martinez

09 October 4th application package sent. This time they said the app signature page was a copy

10 Oct Sent package again 4th time.

25 Oct Received another NOA for Wife with $625 for the amount with one year extension

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

sounds 2 me that she wasn't denied. it seemed they received an RFE. i think ur friend should do some checking up on her atty. he doesn't sound like he knows much about immigration. in the meantime, you guys can post questions here on VJ. Most of us here have gone thru this whole process (USCIS) and can tell u exactly what it is you need to do or don't.
