I-94 valid 3 months, and then what? Also: driving license?

hello everyone!

here's a quick question:

I just sent the paperwork for my AOS/EAD/AP..

My I-94 says "valid until July 10"..

But i understand AOS can take up to one year.. So what happens after July 10th?

I also just went to the DMV office (san francisco), and they told me i can't have a DL with this I-94 in hand! So how can i get a much needed DL?

After July 10 you no longer have K1 status.

You can probably get a drivers license on the basis of your EAD, when you have that in hand.

You can probably get a drivers license on the basis of your EAD, when you have that in hand.

I understand I won't have K1 status anymore, but that's my question, what will i have to say to anyone asking me for my id (passport) after July 10?

I got married, and sent the AOS. but how can i prove this? Do i have to walk with my NOA, when i get it, in my wallet?

Have been asked a lot for your ID since you arrived??? and why would they need to know your immigration status???

I have been here since Feb 2005 and have never been asked for ID or about my status.... if you are stopped by Immigration or the Police you can produce the NOA at your local station if needed...

Your status after July 10th will be AOS(pending) and once you have your EAD you have Proof of your Status...

Nobody is likely to ask about your status... if need be you can tell them that you have applied for AOS and are waiting for your greencard, and if they have a real need to know then you can show them your NOA1 as proof that you sent the application in. Soon you'll have your EAD to show them that you're legal so you won't have to worry about it.

And alas, no you can't get a new drivers licence till you have your EAD.

Ahhh, I guess i'll have to wait for my EAD... I was looking forward to drive in the country while waiting for it. What else is a VisaJourneyer supposed to do when he or she can't work? :lol:

I did manage to rent a car lately, the people at the rental office didn't say anything.. :no::devil:

As for my status, i was just a bit worried about my I94 saying valid until July 10th. I suppose my AOS apllication overrules the I94....?

Not sure about California but in some states, you can get a driver's license if you have a social security card. A K-1 visa makes you eligible to get a SSN card.

After your I-94 expires you are classified as being out of status as you have a petition for aos pending. Its not an illegal status and as long as your petition is pending and you don't go outside the US and behave, you can't be deported.

Can't help on the driving license question, but some states allow you to drive on a foreign licence up to 1 year after entering the united states. This is the way it is in Texas as the US has reciprocity with the UK and i recently got into a car crash and the police officers verified that my license was valid.

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

March 6th 2014 - USPS shows packet was delivered at NVC

March 10th 2014 - AOS shows as paid in the CEAC portal/AOS logged into system as being received by NVC.

March 11th 2014 - New case number assigned for my Dad.

March 20th 2014 - Paid IV fee for my Mum.

March 25th 2014 - AOS accepted by NVC with no checklist.

March 26th 2014 - Filled in and submitted DS-260 for my Mum

March 31st 2014 - AOS found in my Mum's file for my Dad - accepted and placed into his file/IV fee available for my Dad and Paid.

April 1st - Mailed all civil documents to NVC for both parents.

April 3rd: IV fee shows as paid in portal/submitted DS-260 for my Dad.

April 22nd: checklist issued for civil documents - NVC error ...

April 23rd: sent another certified copy of my marriage certificate

April 24th: Case complete! :)

April 30th 2014 - Medical scheduled for parents at Knightsbridge in London

June 11th: Interview at London Embassy - Approved :)

If anyone asks for your ID show it to them. Your passport will be fine for that purpose, it's an excellent ID both before and after July 10 (unless it expires on that day along with your K1 immigration status).

Your NOA is not an ID.

the dmv in San Francisco told me my I94 has to been valid at least 10 weeks, when i apply for a DL..

I'm gonna check with the SF uscis center, just in case...

And I have my SSN now. I applied for it 2 days after my arrival, and had to convince the clerk my K1 made me elligible. :o
