Hi,

I am a British citizen on a K1 Fiance Visa which was granted at the end of December from the London embassy with a 6 month duration, expiring on June 18th. I travelled to the US at the end of March and our wedding is June 3rd.

My fiance and I are marrying in Minnesota and several days later going on a honeymoon to Hawaii, although we plan to send off the application for the AOS before we leave for the island.

We fly back to the U.S. on June 17th so I wonder if anyone knows how one is classified or if there are any problems when you have an expired K1 visa but are still waiting for the AOS to come through???

Any help is much appreciated.

Nov 01 - William comes to know Jesus. Life changes for the better and becomes fulfilling!!

Dec 01 - William flies home, but Amanda is the first person he misses and calls when back.

Mar 02 - Amanda and friends visit England and William

Summer 03 - William and Amanda email and phone

Nov 03 - William returns to the US. Over dinner he nervously tells Amanda he likes her.

Mar 04 - Amanda visits William in England; he surprises her with a trip to Paris.

Aug 04 - Over-worked Will misses his girlfriend so flies to see Amanda for a week.

Dec 04 - William flies to spend Christmas with much missed Amanda.

Mar 05 - Miraculously, God provides a way for Will to see Amanda as work sends him to US.

30th Apr 05 - At a coffee shop in Fargo, ND, William proposes to beautiful Amanda.

“What? Are you kidding me? What…?” Amanda shocked. But says “Yes!”

6th May 05 - Having assembled the paperwork, we post the I-129F to Nebraska USCIS

9th May 05 - NOA 1 – Our receipt is dated from the USCIS in Nebraska

12th May 05 - Our paper work is looked at.

16th May 05 - William leaves his fiancé to fly to England. Deep sadness. God is our strength.

25th July 05 - NOA 2

31st October - Medical

16th Nov 05 - Packet 4

19th Dec 05 - Interview at US embassy

24th Mar 06 - Will flies to the US via NY JFK POE

3rd JUN 06 - OUR WEDDING DAY!

29th Jun 06 - AOS applied for

24th Oct 06 - AOS interview

All of those dates are irrelevant, because Hawaii is still the United States. You wont even need a passport if you've gotten your drivers license.

Enjoy your honeymoon! We will be in Maui at the same time, maybe we'll see you there :)

9-24-05 - Proposed! (Slightly out of order on this!)

10-11-05 - Packet 3 received in Germany

11-18-05 - Mailed Packet 3 Checklist back in

11-29-05 - Medical and Police Check Completed

1-30-06 - Interview, APPROVED!!

4-1-06 - Together in the US

6-6-06 - Married!

6-28-06 - Mailed I-485 (AOS), I-765 (EAD), I-131 (AP) and lots of $$$ to Chicago

7-7-06 - Recieved NOA1 for all 3 applications

7-26-06 - Biometrics scheduled and completed (for both EAD and AP)

9-18-06 - RFE Mailed. Need translated Birth C.

10-9-06 - RFE Sent back in, Case touched.

10-31-06 - AP and EAD Approved!

*1-23-07 - Interview Date! (received in mail on 12/4/06)

One thing to remember if you are planning on moving from place to place is.The US immagration people look very hard at someone that changes their address.It for some reson looks suspicious to them and can cause any immagration applications to take longer.It would also affect your security clearance to bee slowed down,and we already know how sloooowwwww that can be.

09/11/04...By e-mail I-129F APPROVED and NOA-2mailed 08/Nov./04

12/11/04...Received NOA-2 from CSC.NVC received I-129F APPROVAL from USCIC

16/11/04...Receive e-mail from NVC,entering approved petetion into the system and assigned a case #

20/11/04...Receive letter from NVC they have I-129F and assiagned a BNK case #

29/11/04...Turn in DS-230part 1 and check list to US Consulate Thailand.They also asked for 2 photos of Yai at this time.Did not recieve interview date at this time due to person assigning dates left for the day.Will recieve date in the mail,took 1 hour

07/12/04...Yai recieves letter with instrutions about interview from US Consulate with invterview date

24/02/05...Pay Visa fee in Bangkok at Post office

01/03/05...Yai has visa interview

02/03/05...We pick up Visa!!!!!!!!!!!!!!!!!!

02/06/05...Welcome to the U.S.A.

04/15/06...Offical marriage in U.S.A.(Tax Day) ;) ;)

Everything we have done was without the help of an attorney.We have not had any problems thus far and will not,I believe.

William you will be fine as Hawaii is within the United States, you have nothing to worry about as far as you and your SO being out of the country.

I get what you mean about the AOS, I have read on VJ somewhere that it starts when you actually come into the country with you I-94 that is the way I have read it, so you are fine with it all, as long as it is within 90 days of you entering the United States, having said that I have read that some people have started the AOS process after the 90 day period. As you have said you are filling in the paperwork before you leave for your honeymoon then I would say not to worry about it too much.

I think you have read the original post wrong, they are not planning on moving they are simply having a honeymoon lol.

Yeah, the fact that we are going to Hawaii is incidental. My concern was, since I received my K1 on 21st December 2005 (and it has 6 months (or 90 days from the first visit into the US) on it) it expires on June 18th 2006.

We'll apply for the AOS right after we are married on June 3rd, and 2 weeks later my K1 will expire. Therefore when my K1 has expired while my Adjustment of Status is still pending, am I still leagl in the US?

It confuses me.

Just remember once you come into the US your basically in limbo until your green card comes, you get AP or you leave the country, in which that case your really screwed!!!

If you have applied for your AOS and got your NOA 1 letter to show it, you are legal...

Since you're not leaving the US you shouldn't have any problem...

Everybody applying for AOS from K1 has their visa expire. Don't worry, just don't leave the country until you have the green card or AP. You shouldn't have to show anything to travel to Hawaii.
