To all

Just sent in my wifes AOS/EAD/AP paperwork and depending on the time it takes it could be up to one year-ish. I'm a member of the military and may be moving overseas (England) before my wifes AOS/EAD gets approved, is there a longer term parole available if I need to in the future tha still allows her adjustment process to continue?

Ya that is what I thought too, but since it would because of a military required move I'm figuring there must be something. Anything can be waivered. The funny thing is the Brits would be giving her a visa for over there right off the plane.

yeah each country different rules, mmmm perhaps once she gets AP she could spend 2 to 3 months with u and then come back and wait for the card.....better that than nothing :(, im sorry im not more help i understand your feeling, we go throught so much and again having to be apart not nice

No problem, it is a odd case. Just haven't seen anything that is close. Just looking for ideas.

I have thought about that but I would be moving over there (3 year tour), so coming back to the US is not a great option, but yes an option to consider.

Your post should have legal staff who can advise you on how your re-assignment overseas will, or will not, affect your wife's adjustment.

I would agree, but I'm pretty for sure this is such a special case they don't have the legal experts here.

Another question - once a AOS has occured do you have to live in the US during the 2 yer period before adjusting to permanent residency.

Have you inquired? Your case is not particularly special - a lot of service people marry aliens and get re-assigned, into or out of the USA. There are provisions in the INA for some of the unique aspects of being in the military services.

If you can't find the legal expertise you need on your post, find an immigration attorney off post to discuss your situation.

Your closing sentence does not make sense - once AOS has occured one has adjusted to permanent residency, by definition. That's what AOS is - adjustment of status.
