My husband was given work authorization when he arrived at JFK and it is going to expire next week he has a job so will he have to quit till he gets another card? He has his biometrics appt tomorrow will they extend his work authorization date? Thanks

The Temp EAD you get on a K1 at POE can not be extended... he will have to stop work until he get the 1 year EAD after his Biometrics have been done...

My understanding is that he can continue to work as long as he provides proof that he has officiall filed for the new EAD. The employer will then require a copy of the new EAD.

The EAD from a K1 expires when the K1 expires... because the 1 year EAD is linked to AOS it is a new application and you have to wait until you have the card in your hand before you can start work...

you employer has to see the EAD within 3 days or 90 days for a renewal card... as this is not a renewal it is a new application you must stop work and wait...

make a infopass appointment to check if you are in any doubt..

If it helps any, see if his employer will allow him a temporary 'leave of absence'. He is not able to work without the EAD, but with both my original EAD and my renewal the cards were received about 1 week after the biometrics appointment - and that included the time spent in the mail. He may not have a very long wait after his appointment, and if his employer will consider keeping him on the payroll but not giving him any hours so he doesn't work until the card comes in, it might be the best solution.

In my instance I had to completely stop working even though my EAD application was filed way in advance. Once his temporary EAD card expires he is supposed to stop working. Some employers turn a blind eye if you have already submitted an application to have the 1 year card done but it all depends on the employer and the risk they are willing to take.
