CSC transfer criteria...

hey guys,

i am sure this was posted in the old forum somewhere but i don't see it.

what exactly is the criteria to get a CSC transfer. my understanding was if you sent the certified copy of the marriage certificate and was within the original 90 days and i guess have straightforward evidence for I-864, that your chances were good.

however, have there been cases where a CSC transfer has occured when the couple is outside of the 90 days?

if there are USCIS links or VJ links that address this, i'd be grateful.

My sense is that if whoever looks over the I-485 submission at the NBC thinks it can be approved without an interview, it gets sent to the CSC.

If whoever looks it over at the CSC agrees, it gets approved. If they do not agree, it gets sent back to NBC.

My sense is also that "exact" is not a word that is very applicable to immigration - it's a very subjective process, intentionally so.

Sending a certified copy of your marriage certificate is definitely not required - we just sent a photocopy of ours and were still transferred to CSC (although they might send us an RFE later, who knows).

My impression is that most transferees have a busy/backlogged local office.. I can't see any other obvious pattern!

Yes there is... me! We didn't get to file for my AOS until we'd been married for close to six months which of course meant my I94 had long ago run out, and we got transferred to CSC and I got my greencard with no hassles whatsoever.

There is no discernable pattern to the transfers - I think they pull case numbers out of a hat!

there is hope yet... i was afraid that since we will be over the 90 days that we would automatically be excluded from a CSC transfer. i'll keep my fingers (and toes) crossed.

Is it only K1 people who are doing the aos who get transferred to CSC?

No. I'm not a K1 (came in on B1/B2) and was transferred to CSC. I've also heard of other non-K1s who were transferred.

So, as already indicated, there is no specific criteria so to who gets transferred.
