Can I submit DS230 without Police Certificate?

My wife's PCC is taking a long time and i'm frustrated now. I just called the NVC and said you can submit it without but your case will not be complete until you submit all required documents. I even asked her the option of submitting PCC just at consulate but she said you cant do that.

Do you guys think I should start the process of DS230 w/o PCC?

At least my file will be in there queue to be processed as it generally takes 3 weeks for them to process DS230 and I submit PCC later on?

If you send the incomplete packet they will process it, but the missing Documents will generate an RFE. Once the RFE is generated you can send the rest of the documents back....but I would NOT do it, here's why: It can take them 2 - 4 weeks to process your ds-230 an probably another week for you to get the RFE in the mail. If you get the PCC in the meantime you'll be stuck waiting for them to generate the RFE.

If you decide to send the document before they generate the RFE, then you'll be in the position of hoping that they will correctly add it to your packet.

It's probably best to wait and send the packet via USPS Overnight Express. Spend this time reviewing the forms (again), get your express envelope ready so that you can mail that same day or the next.

I agree with t0+ and did a good explaination as well.. My suggestion is to wait and get the PCC and than mail the DS-230 with other required documents. Once you are in RFE checklist, it is just a guessing game to wait for completion of the case.. So why not wait now... Do you know when your wife will get the PCC from Mumbai.. Is it from the passport office or police station ?? Good Luck :thumbs:

Hello Mystique,

I submitted my DS230 with local police station PCC but without PCC from passport office. Today, I called NVC and operator told me that I was missing PCC from all the submitted documents and they cannot continue the process until they receive that. So, makesure you have PCC from local police station and from passport office too...

I also asked the option of submitting at interview and she said no it has to be submitted at NVC to complete the case.

I definitely can wait as its seems RFE process is more hassle than having all documents given to them upfront. But why is this RFE..and not just a missing document. I thought RFE is something like more evidence for an existing document.

I am hoping I just get to submit 1 PCC from passport office as it says if ur passport was issued within last 6 months of interview date, then you only need 1 from passport office. Her 6 months to issue expires on Nov15th so this will also only work if interview is before Nov 15th. I hope it is..

I have read on the New Delhi Embassy page that you can submit DS2001 and Ds230 only and get a case complete. below is directly from New Delhi Embassy Website for petitions file in US with USCIS. I was going to try this since they told my wife to present call letter before the passport office will issue PCC. It may be worth asking about.

IMMIGRANT VISAS

Family-based, Immediate Relatives

Petition filed in the U.S.

Visa Processing at the National Visa Center

On receipt of the approved petition from the U.S. Citizenship and Immigration Service (USCIS), the National Visa Center (NVC) will send the applicant (beneficiary) the Form DS-3032, Choice of Address and Agent Form and the petitioner an Affidavit of Support, processing fee bill.

What is a Form DS-3032 and what does the applicant do with it?

Form DS-3032 is used by the applicant to nominate an "agent" to assist with their application and to specify a mailing address to be used by the NVC. The "agent" may be the one who filed the immigrant visa petition, an attorney, friend, or non-governmental or community-based organization. The agent cannot sign documents for the applicant, but can assist with fee payments and document collection. Note: If the Form DS-3032 is not returned within one year, the NVC will begin terminating the case.

Is the applicant required to nominate an agent?

There is no requirement that the applicant nominate an agent. The NVC may send all correspondence directly to the applicant if the applicant wishes. The applicant should complete the relevant section of the DS-3032 and return the form directly to the NVC.

When is a DS-3032 not required?

A DS-3032 is not required if a Form G-28, Notice of Entry of Appearance as Attorney or Representative is received from USCIS indicating that an attorney is the agent, the applicant filed the petition on his or her behalf, or a child is being adopted.

What happens once the NVC has received the DS-3032?

On receipt of the DS-3032, the NVC will mail the agent or applicant instructions about how to apply for the immigrant visa, including information about how to pay the mandatory visa processing fee and who has to pay it. On payment of the fee, the NVC will mail the agent or applicant the "Instruction Package for Immigrant Visa Applicants" that consists of the Form DS-230-Part I, Application for Immigrant Visa and Alien Registration - Biographic Data, and Form DS-2001, Applicant's Declaration of Qualification for Immigrant Visa Interview.

What does the applicant do with the forms?

The biographic data form DS-230-I Part I should be completed for each person applying for a visa, regardless of age. The form may be photocopied if insufficient copies are received. The completed DS-230-Part I should be returned immediately to the NVC. Failure to return DS-230-Part I promptly will delay the processing of the application.

The applicant should assemble all the relevant documents required in support of the application and forward the Form DS-2001, Applicant's Declaration of Qualification for Immigrant Visa Interview to the NVC. What happens next?

The petitioner accepts this responsibility and becomes the relative's sponsor by completing and signing a document called an affidavit of support. This legally enforceable responsibility lasts until your relative becomes a U.S. citizen or can be credited with 40 quarters of work (usually 10 years).

After the petitioner has paid the Form I-864 processing fee the NVC will send a letter with instructions to the petitioner. The petitioner should return a completed Form I-864 to the NVC. When the NVC has reviewed and approved the petitioner's Form I-864 it will be forwarded, along with the petition, to the appropriate Immigrant Visa Unit in India.

kman I think the information on mumbai and delhi embassy pages are outdated. It was the process initially where you just submit DS230 and then embassy/consulate in the country (India in our case) collects all the documents known as Packet 3. I know for my grandmother we had submit PCC and other documents at consulate only not at NVC.

I asked NVC operators twcie and they said that process has changed for faster processing of Visa..and now everything is to be submitted to NVC and then case with all documents forwarded to consulate. I still do not understand how is his process faster... I guess may be b/c it was lot more on consulates abroad and NVC has hired lot of employees to process all this faster...

That is what we call delima. I have no idea what I am going to do, I may call them again and make sure before submitting the DS-230 but what everyone said here is totally right. I rather wait and submit everything at once instead of getting an RFE or RFI.
