hi all

i've filed my aos but chose not to file the I-131 because I expected everything to go through within 3/4 months. I received three RFE's - one is completely valid but the other two are related to my medical which the uscis lost. in any case, I forsee my case being delayed. I am sending in the info related to the valid rfe and want to also now submit an I-131 with it. Do I need to pay a separate fee?

thanks!

NO  A FEE is NOT required for AP that is based on a pending I-485, unless you filed the I-485 BEFORE July 30 2007.

NOTE: If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on or after July 30, 2007, and you paid the I-485 application fee required, then no fee is required to file a request for Advance Parole or for a Refugee Travel Document on Form I-131. You may file the I-131 for Advance Parole or for a Refugee Travel Document concurrently with your I-485, or you may submit the I-131 for Advance Parole or a Refugee Travel Document at a later date. If you file Form I-131 for advance parole or a refugee travel document separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence that you filed and paid the fee for the Form I-485 required on or after July 30, 2007.

There's no fee, but you should include a copy of the I-485 NOA to show that it has been applied and paid for. There's no fees of any kind, you don't do biometrics for AP, only for AOS and EAD.

Do not send it in with your RFE replies. Send it separately to the address in the instructions.
