My fiance and i had set the schedule of going to Las Vegas this October 1-4 to get a quick married. Because that is the only dates available for him to get out from work. But i am worried because my I-194 will expired On October 4. Can this be okay even if i'm late? what do you think in your own opinion? :blink:

No. They are strict about the 90 days and if you file for the AOS and they see that you were married after your visa expired they will most likely deny your permanent resident card. Go get married in the court in your city!! Have your fiance take a morning off work and go to the courthouse, it will be worth it!

I would be very hesitant of waiting till the last possible minute to marry.

You are kind stuck until you marry here...you can't file for anything, can't work, etc. etc. etc.

I would do a small ceremony at the court house and then do something later if you want. We were married 2 weeks after I got here at a very small ceremony.

Your life is totally on hold till you marry when you come down here. I've been here for 6 weeks and I can't wait to work....I'm already antsy. I think I'm going to volunteer.

Get married in your city at the City Hall by the Justice of the Peace. You've spent a lot of time getting a K-1. Don't waste 90 days in the US and have your Visa expire before you marry! You are cutting it very close. Get married today!

Huh? The K1 allows you to work, get a SSN, etc. Provided you do it soon enough, I-94 won't expire within two weeks. At 6weeks, you have options...

You are not allowed to adjust status based on the K-1 visa if you do not marry within the 90 days. You can still adjust but your husband must then file the I-130 form - and pay the additional fee - along with your I-485 application. It would be like wasting the K-1 completely, and now you would need to wait for approval of both the I-130 and the I-485. It isn't worth it. Do a courthouse marriage and then if you want the Vegas wedding afterwards no one said you can't get married again. You just need to make sure you are married before the 90 days expires. As it is you will be out of status once the I-94 expires until you file the AOS and you don't want to accumulate any more out of status days (if any) than you can help.

Yes, you can get a social security number, two weeks after entering the US...but, finding an employer who will hire someone on a K-1 without work authorisation will be hard, despite what everyone says about the K-1 being work auth. Remember, employers have to comply with the I-9...without documentation to prove said work auth. Even when one applies for AND receives the SS card, it will have the notation "Not Authorized for work without DHS Approval". I seriously doubt one would get hired. Now, if one gets a temporary work auth. stamp on arrival in the US, then that person can work for UP TO 90 days...as long as the I-94 is valid.

Getting married at the City Court in your area won't take the whole day. Why wait at the very last day of the 90 days given to you to stay here? Your husband can request a 1 day off from his job to avoid a future problems from the USCIS.

I thought I read something on the Social Security site about the K1 allowing you to work on a K1. The State Dept FAQ's show otherwise. You need an EAD.

I can't work until I have work authorization, I never got a stamp in my passport when I entered.

So, you get married and then file for EAD :)

Also...a SSN takes at least 6 weeks here and I had to wait 3 weeks before applying...

Really, my life is on hold and so are many others.

For what it's worth, you can file an I-765 EAD earlier (before the AOS). But why? It's really not worth the expense from what I can see.

The reason why you came in the US is to get married and be with your fiance.. But for me it seems that your fiance does not have any plans on doing that... I am sorry but I am just telling the truth.. He knows that your visa will expired 4th October, I dont understand why he is pocrastinating of the wedding.. Well, We can give him a benefit of the doubt, but the excuse of not getting him out of work??? Did'nt he plan this first before you arrive? Oh well, too much too say.. I just hate to think worst case scenario.. But whatever happen, just go home.. it is better to be in our home country SAFE than sorry...

chuck, this has been discussed in great detail about a billion times here on VJ .... the confusion is understandable. The K1 does state it's work authorized but the DHS is the final word and they state that you must have EAD so basically the K1 says that you can get an EAD from the DHS. Which us K1's do at AOS. Very confusing..yes.

What it comes down to is that even with a EAD stamp at entry, it expires in 90 days (with the I94). Most employers will not hire you without EAD and will most likely have a problem with a lapse in authorization to work.

I agree, it's not worth the extra money to file for it seperately and probably only get it a few weeks sooner.
