Is my mother eligible for AP?

Hi everyone,

This is for a friend of mine, she just became a US citizen, and her mother came to US about 8 years ago on a B1/B2 visitor visa, then she started overstaying here since 2002.

I understand that her mother will be excuse for her overstay if her US citizen daughter files AOS for her, and there should not be too much problem for her to obtain a EAD based on her AOS pending.

My question is how about the I-131 (AP)? will she be eligible for an AP? Since she overstayed here more than 1 year, will she be punished by 10 years banned to enter US again?

Thank you very much!

If she attempts to use an AP to re-enter the USA she will be banned for 10 years. she should not leave until she has a greencard in her hand.
