Hi Everyone, my husband and I are petitioning for his son to come to the US. We filed an I-130 for him in April and just received an RFE notice asking for proof that the child's mother and my husband (the child's father) are legally divorced. They were never married - so I'm not sure how to proceed with answering the RFE. Any info or advice would be greatly appreciated!

I'm not sure how to answer your question but as no one else has weighed in I'll venture a guess. Some countries have a proof of singleness that you can obtain from national record offices. If the person who applied is not single the previous marriages will show up. If your husband's country has that document maybe you could try and get that to establish that he was not married to the mother.

Another idea might be to get a statement from the child's mother stating that she and your husband were never married and have it notarized.

Just some thoughts. Hopefully some other people will respond with their answers. I'm curious to find out what the solution to this is.
