Filling I-751 but weak on evidence of relationship . . .

Ok, so we're getting ready to file my wife's I-751 (expires 12/15/08). Problem is that we're weak with evidence of relationship but I can explain everything. I'm thinking we're going to get called in for an interview. August 20th was our 2nd wedding anniversary.

This is the deal:

I purchased the house we live in back in 1998 so the title (loan, insurance papers, etc.) are all in my name. I didn't feel like going the the county recorders office just to get that changed and paying fees and stuff.

We still have separate bank accts. but we do fill our taxes jointly.

Of the 3 vehicles we own, 2002 tahoe is in my name (before her), 1998 civic (her car) is in my name (she had a provisional driver's license) when we reg. the car. 2005 camry (my car) we're both on title.

Just recently added her name to all utility bills. Still waiting for one with both names to show up.

We have no children. She's going to college and working. We have talked about this tho.

On the plus side, besides filing taxes joinly we have my work insurance papers showing she my dependant. All her work and school papers come to the house we share. Is there anything else I can use to show evidence of relationship that I have over looked?

So, open up a joint checking account with your spouse and get some money in it. Suggest that she use that as her account and explain it is primarily for the show of joint ownership. If you can, get a credit card in both names and charge something. You still have time to get a few months worth of statements before you need to file.

Do you have friends that are willing to sign affidavits of knowing the two of you as a married couple? If you are not willing or ready to put your spouse on title of the home, then in your letter to the USCIS provide them an explanation that you were advised by an attorney to not change title in your home for at least five years. Tell them that in California you could lose your home in the event of a divorce if you changed title so soon after marriage. If you have documents showing your spouse as the beneficiary of life insurance or retirement, then include that by all means.

Timeline

Include copy of DL. Apply for credit card that shows both name. Chase card statment always shows both name on statments. What about photos? Do you have some together with family members. That will work out. Have you ever travelled together? If so attach copy of tickets. Go to your bank with your partner and add your partner name to your account. Ask them to send them a statment as soon as possible. You will be okay and no need to worry.

Timeline

Download and fill out an Advanced directive on both of you with the other as decision maker. All you have to do is have that notarized.

Junk mail

Did you take any trips together? Proof of that.

Car insurance? Homeowners insurance? life insurance?

Pictures?

I suggest some affidavits in this case as well.

Thanks for all the replies.

Yes, we have my work provided health insurance where she is my dependent plus auto insurance with our names on it and all the utility bills too.

We went to the bank yesterday and got a letter from them stating that the acct is a join acct since 10/06 because only my name appears on the monthly statement (bank policy).

We do have a ton of pix with us and my family.

I'm thinking we will do the affidavits too. We have a few folks that attended the wedding and see us on a regular basis.
