OK. So we've made it this far without any RFEs. But his pisses me off.

We sent:

3 years of tax returns

Joint leases throughout our marraige

title and morgtage papers saying we bought a house together.

8 months of current utility bills

joint car insurance bills for 2.5 years

proof we are both certified to be foster parents

proof we are both members of our church

We do NOT have joint checking accounts.

So what more...besides affidavents from others (can I use friends and family?) do they want?

I'm pregnant...which really doesn't prove anything since the baby isn't born yet. But should I include that evidence as well. What else can I possibly send them.

Definitely include evidence of your pregnancy.

Affidavits from friends, pastor of your church, etc.

Do you have anything that lists that you are the beneficiaries for each other -- life insurance, investments, wills, etc?

More financial evidence that spans the length of your entire marriage.

Show how you have co-mingled your day-to-day finances, since you do not have joint accounts.

Show a sample of photographs that span the life of your marriage.

Oh, and what does the RFE specifically ask for? Because that's what you need to concentrate on.

Thanks for the ideas....the RFE included every category...it didn't say specifically. But financial, affadavits, proof of co-existence throughout marraige, a statement of our story of how we met, and other things...I don't have it in front of me right now.

Story of how you met is not necessary. That was proven before.

Yeah, but it was in the RFE....a statement of how we met and how are marraige is.

If they didn't specify what you were lacking, then assume everything was inadequate. This time overwhelm them with documentation. They are primarily looking for financial transactions that include both of you. But don't forget to provide them with lots of personal stuff including pictures, information on vacations, family gatherings or anything else that shows the two of you together.

Make sure that everything is properly labeled and fastened together. It could be that what you sent fell apart and they could not organize it back into something they could use. Think about the thousands of documents, photos, etc. that they get every day and just imagine what it would look like if a stack of them fell to the floor and got mixed up.

Remember that their files have top two hole punched fastener, so either keep yours together in that fashion or insure they can do it that way. You might highlight the important parts on copies of documents to make it easier for them to find what they need.

Just do an exceptional job of organizing it and you will be fine.

My packet was pretty organized before. I am so pissed off right now.

September 23, 2005--Walk-in biometrics completed

October 1, 2005--fingerprints received/processing resumed

November 26, 2005--EAD card received in mail

June 7, 2006--contact senators about AOS

June 28, 2006--senator says interview date is for August 14!!

August 14, 2006--AOS interview and 1 year wedding anniversary

I guess sending big files with pictures and utility bills and other is what they are looking for.

Just add more staff-even e-mails, junk mail to your address-make it big folder.

Inlude copy of Driver License that shows the same address. If your partner have checking account go with him to the bank and ask them to add your name and print the latest statment. Apply for a credit card or add your name to the card. Make copy of your both card with statment of account. Make some new photos. Attach anything showing both names that you received from the IRS office. If you don't have a checking/saving account apply without further delay. What about utility bills? Do you have any? If you have add your name too. Some times they lost your package so don't forget to attach something from last couple of years. Good luck!!!

Your evidence looks quite good in terms of 'kinds of things', I'm wondering if they want to see the entire time since you've become a Conditional PR. (Although I must say that with the lease and the tax returns, that's pretty good).

Perhaps the absence of joint accounts made them send a generic RFE. If worst comes to worst, you can explain everything, they can't compel you to live your life in a way that USCs don't.

Yeah we don't have alot of joint stuff from the time we got the greencrad and moved from Hawaii to Oregon, until the time we bought the house (which is about 11 months)--except for the car insurance and joint leases and tax returns. Frustrated.....................

Perhaps that's what it is then. I bet they sent a generic RFE based on evidence coverage, rather than lack of evidence. Still, car insurance and joint leases/returns is pretty damn good evidence, especially considering you moved from Hawaii to Oregon, which isn't exactly easy to fake a relationship and move that kind of distance.

Unfortunately, you may have gotten an adjudicator who's a bit of a stickler. If it makes you feel better, a lot of people who respond to an RFE usually get their approvals fairly quickly after they send in a response.

also I would include bills, memberships, accounts etc that are in either your name or your SO's name.. I know it isn't joint accounts etc but it would still show that you live at the same address....

If you just sent copies of your tax returns, send the IRS transcripts of the you tax returns with your new package.

Don't let the RFE stress you out too much, especially because you're pregnant. You have plenty of proofs, it's just a tiny bump. And based on other cases I've read in this forum, cases get approved a week after USCIS receives the new evidences.

BTW, what's your I751 timeline? It's not on your signature or VJ timeline.

I feel your pain. We too got a RFE. I had originally only sent in the first page copy of bank statements and Tax returns. The RFE asked for entire copies of tax returns including copies of our W2 forms also. They wanted detailed evidence and that is what I sent them the second time. They also requested copies of our drivers licenses. They also requested entire copies of lease agreements with both of our signatures on them.

We included copies of photos with descriptions. We also got 4 sworn affidavits from family. I also had to write a statement describing how we met, and details of important events in our marriage.

We two hole punched everything and organized it very well. In less that a week of them receiving the RFE we were approved and the 10 year card was sent out very quickly.

So try not to get too worried about it, just copy everything and highlight any relevant information. Read the RFE carefully and cover everything they ask for. If you can not produce any evidence they requested write an explanation as to why you can not, that way they won't think you are ignoring anything.

We also received RFE, and sent the same stuff we sent last time in July. We filed our I-751 in June 2007 to TSC. It was transferred to VSC in February 2008. Finally we received an email from CRIS on August 29, 2008. It said "Current Status: Card production ordered". 10 yrs card doesn't get our mailbox yet, we have to wait a bit more. We really hope our long journey of I-751 is finished, and all filers on USCIS have a short and best (no RFE, no misprint card...) journey. "hang in there!"

Evidence of stuff that is not easy to get unless you are really married, like health insurance, and if you have auto insurance, a copy of yours and your husbands driver's license. Get a note from your doctor you are pregnant, and I don't see a copy of your green card listed. They asked for two affidavits, we sent four, two from relatives and two from friends, all were notarized, what about a copy of your marriage certificate? To me utility bills are a joke, can call them and say anyone is my wife, what do they know. Since our daughter was part of it, laid down SS cards, driver's license, and green cards on my scanner and printed out a color print of all of them including my own. Plus I threw in her report card that was mailed to us.

But stuff happens, a friend of my wife's got a RFE, but she questioned why, and was told they lost hers, but she had an honest interviewer, that doesn't necessarily happen, never admit fault is the policy of some. USCIS has a noose around our necks and they can pull on the other end, have to bend over backwards to please them. Didn't see a cover letter either, I typed that out as the USC spouse for my wife and listed all the evidence we enclosed. And while doing the I-751 made duplicate copies of everything, but when you do that, they don't need them.

Wife had her citizen interview over a month ago, got a new interviewer, when we got in the car, asked my wife to repeat step by step her interview, it didn't sound right regarding the story she was given regarding her oath letter. We waited another month, called my senator's office, same deal about processing dates, forget that, it's a bad joke, but please make an inquiry for us about that oath letter. They did and received it the next day. It was a battle from the very beginning to the end, and hopefully, this Wednesday, the day after tomorrow, our battle will be over with. A very long over five years of this stuff.

Photographs? How about our walk in closet with hers and my clothes in it, her vanity table loaded with all that womens stuff, the mantle with stuff from her home country with both of us in it. Ha, was tempted to send a video of us making love. But for what we had to go through to get a marriage license in our state, that should have been enough.

Thanks everyone for the replies. We sent in MORE evidence yesterday. Hopefully they will be satisfied. The RFE latters had some crazy things on it..like requiring a statement of how we met, married, a list of wedding attendants (???), significant moments in our marriage. They also asked for a G325-A for the both of us. I'm still angry over this, but hope we will get the approval soon.

Stuff I sent in (different from the first time):

  • american express statements showing him as authorized user
  • joint car loan (although we sold the car one month later)
  • more utility bills in both our names
  • more stuff showing we bought a house together
  • tons of pictures
  • two affadavits
  • car insurance (again)
  • proof he is benficiary on my work benefits
  • letter stating I was on his work's health insurance
  • letter stating he is on my work's insurance
  • ultrasound pictures, notes from the doctor showing I am pregnant
  • a 2 page statement
  • G325As for the both of us
  • joint lease to own for buying a tv

Hope this does it.
