I am engaged to US citizen and we are living in England, where he has visa until 31/08/09. We want to live in States from 08/09. We are happy to marry in either country, but I would like to be working ASAP after arriving in USA. Is it better for us to get K1 and then AOS or will it take a long time for me to work this way? Or should we get married here and apply for K3 ASAP? We have been together for 4 years.

All advice welcome, and any ideas of how long either process will take would be great!

Neither... You want an immigrant visa. Get married and do what is known as direct consulate filed (DCF) of the I-130 petition. This is the fastest and allows the intended immigrant to work upon entry into the US.

It's a DCF country but your fiance is leaving in a week an has no visa allowing message. You want an immigrant visa, like I told you in the K1 forum. CR1 is the immigrant visa for spouse.

I think they allow.... I am certain they allow... Go to the DCF forum.... What makes DCF difficult is the minimum 6 month residency for the USC.... I am sure your situation overcomes that...

In the event you cannot DCF, the immigrant visa is still the best one.. so you file the I-130 stateside rather than London

Probably. Why can't the bloody Brits use proper American English anyway. The US needs to be more Imperially assertive when we win a war next time. :thumbs:

They WILL need to deal with that whole "getting married in the UK" issue. Not sure how that works if she's already there.

You can do DCF if he has legal residence in the country.... but as always the London consulate is the final say

Maybe the bigger question is will your country allow the marriage to occur?

I have read on another website that students do not qualify for DCF as they are not here on a permanent basis. I will still check this with the embassy, but if it is the case, what is the next best option, K1 or K3?
