Hi everyone I am so thankful for this site...........I had a couple questions and thankyou for anybody who responds...........I submitted my k1 visa and recieved the following message On July 22, 2008, we received this I129F PETITION FOR FIANCE(E), This case is at our CALIFORNIA SERVICE CENTER location....

The following are questions I hope you can help me with.

Im looking at the charts for timelines and im not sure what they are telling me? If you can explain them thanks.

The attorney is telling me in October I should here something I guess Im just trying to verify this information.

Also if we are aproved and then married how soon can she travel back to her country.........I know leaving will be hard so i want to know how soon she can see her family.

Im trying to set up a signature like you all is this a good start

Welcome to VJ. :)

October seems a bit early for a K1 filed through CSC at the end of July. Right now you're looking at at least 4 months to approval then more time to interview.

After your fiance is here and you marry you can file for AOS (adjustment of status). Included in the AOS cost ($1010) is EAD (work authorization from DHS) and AP (advanced parole..allowing her to travel). She can leave the Country (US) to travel home as soon as she has AP...usually 2-3 months.

Keep in mind... if she leaves before AP, she will most likely not be able to get back in as K1 is a 1 time entry only visa. You will need to start the process over with a spousal visa. ;)

To set up your signature go to 'My Assistant' at the top and click on edit forum signature.

Also, please fill in a timeline as it helps us all.

I thought that did not sound correct when she told me that.....4 months would put us at Nov 22........and 4 months for the interview would be March 22 2009..........KimandRuss thankyou that helpful information...My love will he very happy becuase she was given incorrect information and was told she has to wait 3 years before returning to her country................i will fill in my timeline thanks again

what does touched mean?

Nothing really. Somebody did something to your file, so a date changes in your internet record. Neither of my petitions ever showed a touch.

So is NOA1 the date they recieved the file and gave me my tracking number? Im trying to understand the people signatures and what NOA1 and NOA2 mean?

If im correct NOA1 would be July 22, 2008 for me?

Your lawyer is correct...expect to wait 3-4 months to get approval for her to apply for a visa in her home country. Then expect another 3-month wait to be interviewed for the visa. After marriage, once you have all the documents together (that can take a few weeks to obtain), apply for the green card and work permit (AOS and EAD) and also advance parole (AP). AP permits her to travel and be allowed to re-enter the U.S. Allow 3-8 months for all these to be approved. Good luck!

My financee wants to travel here in October is this allowed durring the K1 visa proccess?

Our attorney says yes i just want to make sure

Also last time she traveled they worked her over pretty good at the airport.....She hasdto dump out her purse and was called into a room were two people were asking her questions...she was lead to tears during this.... I was called on my phone at the same time 5 am thank goodness i answered and was asked a few quick questions and they said goodbye thankyou and she was allowed to procced. They wanted to know what reason she had for coming back to her country and it better be a good one......I pay alot of money for these plane tickets and thank the lord that she was let through to see me............Connections are in Miami or houston i think are the only two airports.....She thinks that Miami is the better one because of past expierences and all the drama she had to go through in the Texas airport...................

As far as travel, it is 'allowed' but, of course, having a US fiance (if they know about you) will add more scrutiny to her entry. The best you can do is have her travel with plenty of ties to her home Country and perhaps have a backup plan. Considering she was already pulled into secondary they will have all of the information she told them the last time in their system. They will usually not know about the K1 unless you tell them. They don't 'need' to know but if asked, you should always be honest. Misrepresentation is not taken lightly. You will want to be certain she can prove she is going home.

My love was denied entry a year ago but we had taken advantage of the VWP and he had been basically 'living' in the US on that visa for a year. Even with a valid visa it is at the discretion of the POE officer to allow your fiance into the Country. If he/she believes there is immigrant intent she may not be allowed in.

Look up at one of your posts. On the left where your name is, look under the flag and there's a link to My Timeline. Click that and you can fill out a timeline for VJ. It will give you an estimate of the second notice (approval by USCIS) aka NOA2. It changes as people add their own information but it's a statistical took that will give you some estimate. So far you can put in the date you mailed it, the service center, and NOA1 (the date printed on your receipt notice).

I just filled out my timeline and did not see a selection for a conulate for Guayaquil, Ecuador...the only I could see available was Quito..From what I understand there is one there.....Is this just not a option available?

See answer to your separate post about this. You're very fortunate to have found VJ, because you WILL need to rely on those of us who have, uh, "experienced" the Guayaquil consulate.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
