I-130 APPROVED 21 DAYS FROM FILING :)

Hi guys!

I was awakened at 3:48 Manila time by a YM message from my husband saying that he got the I-130 approval notice in the mail for both me and my daughter. We had filed that July 28th. The NOA1 was dated July 31st and this one was dated Aug 18th. It said there that the original docs have been sent to NVC. We have not yet filed our I-129F (thanks to the ever-dependable Philpost and USPS...dapat last week pa nakarating sa kanya)..but will in the next couple of days (ki-nourier ko na). It is my understanding that NVC will notify us and the USEM? What should happen next? Are they going to wait for the I-129F?

Admittedly, I had only been asleep for about an hour when the message came and have not been able to sleep again (halata bang excited?), thinking of all that needs to be done. :blink:

12-11-08 - VISAS RECEIVED....YAHOOOOO!!!

04-07-09 - POE: Chicago O'hare

04-28-09 - received SSN's (after having to apply for them personally!!!!)

04-30-09 - Received our 2-year GREEN CARDS

01-07-09 - ROC, here we come!!!

01-18-11 - Mailed out I-751

wow, gracey.. I think that was really fast from NOA1 to NOA2... (am I correct?) :shocked:

Hope me and my husband's case would be as fast as like this too.

oct. 16,2008 -----mailed DS230 overnight

oct. 23,2008 ---- RFE

nov. 3,2008 ----- case complete

nov. 26,2008 --- medical exam

aug. 14,2009 --- remedical finally, passed

aug. 24, 2009 -- interview , passed

aug. 29, 2009 -- visa in hand

sept. 24, 2009 -- POE LAX

First of all..Congrats!!!! That was fast...

You can track your papers thru DHL so you have an idea when ur papers receive by USEM...reference number should be like this " EXP 19 AUGUST2008" Once USEM receive ur papers from NVC give it 3 to 5days before calling for interview appointment because they need to encode your case first to their system.Then you can go for medical anytime u want except on holidays and atleast 1week prior to ur interview...you can do it a month or weeks earlier.

Ur husband can call NVC for the MNL case instead of waiting for the NVC letter that sometimes takes a long time.Then when NVC give ur case number thru phone..you can now pay document verification.

really fast, we recieved NOA2 2months and 15 days after we got our NOA1. lucky you!

the application for I-129F (K3 route) should have been submitted right after you received your NOA1 which was last 31st of July. Since you're I-130 has been approved then id say you should set aside the thought on the K3 process and read more now on the CR1/IR1-CR2/IR2 visa process. now a days, the USCIS (though it has not been clearly told to the public) simply waives the K3 visa application once the I-130 has been approved. why i know about this, based on experience plus i really asked someone from USCIS to clarify the whole thing to me since we were thinking of going through the K3 route.

TRUE, you will be notified, but NOT the USEM just yet but by the NVC. they will send you DS-3032 (Choice of Agent) for yo to proceed with the visa process (now, understandably on the CR1/CR2-IR1/IR2 route). it is best that your petitioner (who has an address abroad - USA address) be your Agent, that is if you have NOT hired an attorney to assist you through the whole process. next comes the fee bills for the I-186 and Immigrant visa application...so on and so forth..

its normal to feel that way, i once did..lol. just stay focus, follow whatever they need you to do and pray of course..

:no: i guess her papers isnt heading for the USEM just yet bluemist..its still heading for the NVC, the OP has not submitted their I-129f (Spouse - K3 route). giving these advices would be too early as of the moment.. ;)

So we need not/cannot file the I-129F? And even if we do file for K3, USEM would disregard it and ask for CR1/CR2-IR1/IR2 instead? I am really confused with this turn of events. We wanted to file for K3 as the process is faster. We were not expecting so quick an approval and we are surprised as well.

And he hasn't slept that well too! :D

with the current turn out of events, YES, you can't file for I-129f anymore considering that the I-130 has been approved. as i have explained above, the I-129f(K3 route - for spouse) should have been submitted way back when the NOA1 was received. your case will now be moved to NVC, if you insist on submitting the I-129f, the USCIS will simply disregard it since it doesnt have an I-130 to pair it with anymore (since your case - your papers are NOW with the NVC).

And even if we do file for K3, USEM would disregard it and ask for CR1/CR2-IR1/IR2 instead?

not USEM. papers go through a certain chain of offices before you get your interiew:

FIRST : USCIS (Application Phase)

SECOND : NVC (Security and Background Checks, Visa Application Payments, etc)

THIRD : USEM (Final Interview, Medical, Local DV)

USEM doesnt disregard anything, they simply are recieving what the NVC has given them. do their own verifications and decides if the beneficiary gets the Visa or not (Passed or Denied). your papers will not get as far as the USEM if the USCIS and NVC has not PROPERLY SCREENED all your documents. but if youre asking if the K3 application will be waived, YES. it will be, believe me..

I am really confused with this turn of events.

you need not be confused..just stay focus and accept the fact that you're well on your way to the CR1/CR2-IR1/IR2 visa process. eventually, you will know it aint a bad thing at all.

We wanted to file for K3 as the process is faster.

we all want everything to be fast..me too, lol. however, the visa category you and your daughter are in now, though a little time consuming (approx 8-11months) is much more hassle-free when you get to the US. if your visas will be granted, you won't have to submit for biometrics and pay 1,010 USD. you will be automatically granted a 5yrs or 10yrs visa (depending on how long you and your husband have been married).

We were not expecting so quick an approval and we are surprised as well.

isn't this world full of surprises! lol..

And he hasn't slept that well too! :D

he better get some good sleep, you still have a bit of a long way to go..
