Tourist Visa Wife Philippines

Hello All:

My wife and I just got married this month - and we are expecting a baby February 14, 2009. However, we cannot file our I-130 or I-129F for several months due to an issue with one of her children.

She is currently a nursing student and has 2 children. We rent an apartment in Manila but I live in the USA.

I would like her to visit for a honeymoon visit during Thanksgiving for maybe 2 weeks. My job is demanding and it is difficult for me to get time off. She would not bring her children. We will be filing our spousal visa sometime in the next 6 months but not likely anytime before then.

Is it possible or likely that she can get a tourist visa ??? Any suggestions ???

From all that I have read on this issue, it is not likely that her B-2 tourist visa would be granted.

And even if it were, there would also be a strong doubt about whether she would be permitted to enter by U.S. authorities at the port of entry.

In summary: Although it may not be impossible, it is probably highly unlikely in most cases.

If most of us could get B-2 tourist visas to ease the pain of our wait for K-1/K-3 visas, we would have already done so. ;)

Unless she has a reason she HAS to return to PI there's not much chance. Kids don't count.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Most likely she will get declined. I went thru exacly the same thing. I am expecting any day now and we tried the B-2 visa just so my husband can come and be presnt for the baby if nothing else. MAin reason he got declined is because he is married to me ( A US citizen) and expecting a baby tgether. They look at how strong his ties to the US are and go from there. In this case marriage and children are the strongest ties you could have. Only way you can bring her is the I-130. Sorry and best of luck.

Btw: I'm sorry: The whole U.S. visa system is completely absurd, and I feel very sorry for the pain this will cause you and your wife.

(If you want to live together in the U.S., you will both have to be very strong and patient.)

His wife could be granted a B-2, and she could fly all the way to the U.S., only to be denied entry at her arrival.

Very possible and it has happened to many people.

So, in that case, the cost would be $131 + ~$1500 (plane fare), to say nothing about the disappointment...

Well, I am kind of in a similar spot as you. My wife and I were both living in Thailand for the first half of the year and we heard that she would more than likely be denied a tourist visa, based on the fact that we are married already. SHE would have to show strong evidence which would suggest that she will be returning to the Philippines. Even under those circumstances, she could very well be denied.

The best thing to do is get back over to the states and file the I-130 petition immediately. Upon receipt of your NOA1 from the I-130, make a photocopy of the NOA1 and submit it with an application for the K-3 (I-129F spouse visa). This is probably your best bet in getting your wife to the US as quickly as possible. You can access all of the visa info on the USCIS website. Good luck in your visa journey! :thumbs:

His wife could be granted a B-2, and she could fly all the way to the U.S., only to be denied entry at her arrival.

Very possible and it has happened to many people.

So, in that case, the cost would be $131 + ~$1500 (plane fare), to say nothing about the disappointment...

BenAndNida thats exacly what I think as well. It is very unlikely for the embassy to grant her a visa but either way you dont want to risk it. Especially now that she is expecting it will be much harder for her to make that trip and have to turn around and return. I am very sorry for the disapointment I know exacly how you feel I am going thru it as we speak but you have to be patient and strong. Everything in its time.

BenAndNida thats exacly what I think as well. It is very unlikely for the embassy to grant her a visa but either way you dont want to risk it. Especially now that she is expecting it will be much harder for her to make that trip and have to turn around and return. I am very sorry for the disapointment I know exacly how you feel I am going thru it as we speak but you have to be patient and strong. Everything in its time.

Not to change the subject here, but congrats with the new baby coming. My wife is currently 8 weeks pregnant with our first baby and it just drives the anxiety level up another notch with this whole visa process! Good luck with the new family and good luck in the rest of your visa journey :thumbs:

I dont know about the immigration process in the Philippines.. But in my case, I did apply first for a visit visa before we filed K3. The Consul in the Middle East granted me 10 yrs visit visa.. My husband was working in the Middle East and we have to visit his family with me on his side for the first time. I dont know if my pregnancy helps but when they interviewed me I told them I was 3 months pregnant and was just planning to visit family for 3 weeks..

Since 9/11 its gotten really bad it is very rare to get a visitor visa for the states if you are marred to a citizen. Like some of us already said you can go ahead and try we wish you best of luck but dont take your hopes too high up most likely dissapointment will be coming your way.

Another thing I wanted to add to this is its better if you go ahead and apply for the I-130 ASAP because since your wife is pregnant you want to have her here soon, if she gives birth in a foreign country that you need to file the same petition for the kid as well... It will be duble the trouble and the cost.

Actually, our baby will automatically be a US citizen. All I have to do is register the birth at the embassy. I have already checked it out - but thank you.
