Why did they even offer her the job if it is for citizens only? It seems sort of strange because I'm sure it's possible to figure out from her application that she isn't a citizen.

On a similar note, I had a discussion once on a job search panel concerning the chances of non-citizens to find jobs in U.S. academia and was told flat out that while it is considered discriminatory by the professional organization hosting the panel to ask for personal information such as age, sexual preference, marital status and the like, it is totally ok to ask for citizenship status and to reject non-native born applicants based on the assumption that they are not citizens. I would assume if they can do that in the so-called politically correct environment of American universities, they can probably do the same in any other job. :angry:

Employers CANNOT discriminate among work-eligible individuals. Theoretically at least, work-authorized aliens, permanent residents, and U.S. citizens all have the same shot at any given job (except for certain government positions).

Bottom line: if your wife is work-authorized and legally present, her potential employer could probably be sued for refusing to hire an otherwise eligible individual solely because she is not a citizen.

funny u should say that, b/c my husband has a friend(nigerian) that came here on K1 visa. he does not have LPR status nor is he a USC, but he has a job at the post office as a letter carrier. he's been here only a little over a year. i still can't understand how that has happened!!!

I think they may have different requirements for what they consider a "temporary employee". Perhaps he is working within that category. Or maybe what they say they require and what they actually do are not quite the same...

As people have said above, except for certain (mostly government-related) jobs it's illegal not to hire her just because she's not a citizen, and usually it's because the boss doesn't know the law, not out of malice.

Personally I work for the US government, and my job is open to any work-authorized alien as well as citizens. So not even all government jobs are citizens-only.

There are some industires that requre you to be a UCS regardless of the position. However you would think that if she needed a security clearence they would have done a backround check before she got hired. Then again that would be the logical thing to do.... :lol:

There are some jobs that are not open to non-citizens. For example some positions in the Federal Government or some positions requiring security clearances.

Isn't that discrimination though?

I think you need to find out what went wrong... Sounds like discrimnation to me...
