Timeline

I need help with my fiance visa sticky situation. She went for interview in Nigeria and was denied. They gave her a paper on whiche they wrote" that her approved visa petition would be returned to the issing state department for possible revocation" Can someone please tell me what this means?

Any help will be appreciated

It means exactly what is sez.

They dont believe that you have a valid relationship, and they are sending the petition back to the USCIS and recommend that is be cancelled/revoked.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

It means exactly what is sez.

They dont believe that you have a valid relationship, and they are sending the petition back to the USCIS and recommend that is be cancelled/revoked.

Just make sure everything is honest. Make sure all the paperwork is correct. Nigeria is one of the #1 for false paperwork and false relationships, according to the ice website

I would think you need to see if you can get the file turned around by contacting your senator/congressman. Once it comes back here it's not likely to do anything but sit and expire, according to those who have had a K1 denied.

Read this thread, it is long but contains very helpful info.

You have to act very quickly to try to keep your case with the embassy. This is very serious.

1. Contact your senator or congressman to intervene and get a second interview appointment. Be present at that interview if granted.

Travel there now if you can, to ask to see the chief consul for an appointment to see you so you can ask for a second appointment in person

yourself ( long shot ). Enter the embassy as a USC for American assistance, then work yourself through to see him. ( Not easy but doable ).

2. Call and email the embassy NOW and ask them for a detailed reason the visa was denied. You need it to know what you have to overcome.

3. Ask yourself what possible red flags you have with your case ( short relationship before filing, short time being together in person, was she able to answer all questions they asked her ? Do you have sufficient relationship proof like emails, phone records, letters etc. )

4. Fax letters of family and friends attesting the validity of your relationship to the embassy or through your representative.

If the case is returned it will expire and die and then and only then you have the option to start over again.

Sorry about that, but you need to provide us with more information about your case in order to give you suggestions.

Are you and your fiance both Nigeria born?If not you need overwhelming evidence to prove your case

What questions / information did they ask her that she can not provide/answer?

Do you have overwhelming prove of your relationship? Pics, E-mail, phone records etc.

Where you in a marriage ,when you claim to be dating her?

They should have told her their reason for denial. Ask her to recollect what transpired during the interview when she settles down.

These and some other questions need to be answered before one can give you a viable suggestion.

It may be of some help to you to get her to scan and email a copy of the denial notice to you so you can see exactly what the letter says. The Consulate Officer should have either told her the reason he/she was returning your petition or there should have been an explanation on the letter your fiance' was given. Either way, contact your Congressman/Senator and ask that they make immediate contact with the Embassy in Lagos to hold the case over for Consulate General review. You can also email the Embassy but it may be 5 to 10 days before they respond, if they respond at all. Good luck.

09/20/08 - Arrived in the US - WHOOOOHOOOOO!

Actually, in re-reading your posts, you said that they said they would do some investigating... I'm not clear if your petition is being returned or if you were put on AP. You definetly need to know exactly what that letter says.

I want to thank everyone for their input. Yes I finally received the denial paper they gave my fiancee. No reason was given except that they were returning the petition to the department of Homeland Security for further review and possible revocation. They added that any inquiry regarding the petition should be directed to that office. I have made a formal inquiry and have also contacted my state senator
