Did you previously applied for another fiance and she got her visa? Your post is unclear.

Yes I applied before and the approval for the visa was just about two years ago. We broke off right about the time the visa was approved so it was never used. I'm just unsure if the approval they speak of is the visa or just the petition in general.

Did you read the "two year rule"?

"If you have filed two or more K-1 visa petitions at any time in the past or previously had a K 1 visa petition approved within 2 years prior to the filing of this petition, you must apply for a waiver."

Of course but It says "petition approved" and I just want to clarify where the two year count starts. Its my understanding that the petition is approved when you get the NOA2. That is what my NOA2 stated for the first petition I submitted....."YOUR PETITION HAS BEEN APPROVED". Then its sent to the embassy for a interview and to make the visa approval determination....which is different then petition approval. I mean just because a petition is approved does not mean you get visa. I'm asking because I just had someone tell me that its based on when the visa was approved but they way I read it its based on the petition approval. They are two very different dates for me but I want to know if someone here knows for sure.

I think it is fairly clear that the PETITION approved date is the beginning of the two year clock....

I agree...I just wanted to make sure because of what I was told. The person that told me it was the visa aproved date actually deals with petitions and I think they are miss informed. Im starting another petition and It will only cause delays if I was wrong so it's better to be safe then sorry.
