Official Notice on IMBRA Waiver Acceptance

Hi all. As part of my I129f, K-1 visa application I included a request for a waiver since this was my second Petition for a different fiancee within

a 2 year period. I received the NOA-1 today, Receipt Notice. Since the NOA1 is for the Visa application can I assume the waiver was approved?

(otherwise why would they process my I129F, K-1 application? )

Anyone have any experience with this? Received date for I-129F was 8-1-2008, Notice date was 8-20-2008.

Absolutely not... NOA1 is merely an aknowledgement receipt of your file... no action has been taken other than it was logged into the system

But before they can log this into the system for the K-1 I129F, they need to approve my waiver. If the waiver is not approved there

is no reason to process the K-1 and take my $455.00. (which they did and it cleared my bank) They've had my package for 3 weeks

so I assumed someone during that time reviewed my waiver request. There is no waiver application fee; the $455.00 is for the I-129F.

Without approval on the waiver there is no need to process the I-129F. (if you see my logic here)

Based on what I know from others, the waiver is usually approved almost on a routine basis. (unless you have a criminal background; which

I do not)

This is my optimistic reasoning. Yeah, I know reason does not always play into their thinking.

It's hard to say. One thing for certain, your visa application isn't approved because you didn't file a visa application. You filed a petition.

Facts are cheap...knowing how to use them is precious...

You are stretching... You paid a fee for a decision to be made on the petition... nothing more, nothing less... Your petition could be denied for many reasons including but not limited to a refusal of your waiver... $455 for this decision, regardless of the outcome.

In addition, you are thinking the mail room clerk has a lot more authority than they do. Waiver approvals must come from much higher up. I guaranty that person is not sitting in the mailroom each day waiting to make decisions on submitted petitions as they arrive.
