K2's using AP without K1 being present for flight

OK this is one which will likely come up for others - and its something I'm curious about as it will affect me after we marry.

My child will be coming WITH me when we emigrate, but she will require AP probably sooner than I will so she can see her birth-father, for access visit, in our country of origin (UK).

She is legally old enough to travel unaccompanied, and willing to do so I should add, and the airline we think it most likely we will use has no problems with unaccompanied minors (she's 10 goin on 11).

However, the actual visa will be in MY passport for K1 - will it pose a problem for when she returns to the US? Obviously she will have her AP document - and Im assuming they will issue one for her alone - and her own passport with the K2 visa in it.

Any thoughts?

Advice?

Hands-on expereince with this?

Or am I worrying unecessarily?

Met online 2001 - just aquaintances

Sept 2002 - 1st US visit - everything goes perfectly.

Dec 20th - Forms recev'd at CSC

Dec 27th - NOA1 received by snail mail!

Dec 29th - 'Touched'

March 10 2006 - NOA2!

March 23 - recv'd at NVC

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received

Probably worrying unnecessarily - she'll be entering the country on her own visa - the K2... so when she gets AP, I see no problem with her coming back.

But alas, I don't have the answer for you, that's why you posted here, so I'll shut up now :-)

Time for the Visa

Dec 8, 2005 - Finally mailed Packet

Dec 20, 2005 - NOA1 Notice Date

Dec 27, 2005 - NOA1 Rcv'd in Mail

Mar 10, 2006 - NOA2 Approved

Mar 23, 2006 - NVC Received Packet

Mar 24, 2006 - Case Forwarded to London Embassy

Apr 7, 2006 - Recieved Packet 3

May 11, 2006 - Packet 3 Sent Back

May 24, 2006 - Medical Appointment

May 24, 2006 - Packet 4 Received

Jun 14, 2006 - Interview - APPROVED!!!!!!!

Jun 16, 2006 - Visa Recieved

This first statement is a bit confusing - am I correct that she has her own passport? (And her K2 visa is in her passport, not in yours?)

Anyway, not quite sure what you're worrying about. As long as she has her passport and her advance parole document, that's what she needs to be parolled into the USA. The visa will be a moot point by that time.

Yes she has her own passport - which will contain her K2 visa - sorry if I wasn't clear Yodrak :)

Thanks tho - I was pretty sure that was the case but I didn't want to make assumptions based on a feeling so cheers :thumbs:

The K2 visa will have served its purpose and she won't need it any more. That's what the AP is for and that will be in her name, not yours (you'll have your own). So you don't have anything to worry about...
