Hi there vj!

I have received RFE for my husbands 2007 taxes. He's filed an extension back in April. We sent the AOS in June, received RFE July 28th. The USCIS requested 2007 tax transcripts so that meant we needed to file now. We did send them electronically today.

My question is how long does it take the IRS to process those taxes so we can order the transcripts. I know it takes around 10 days to receive the transcripts, but since we just filed them today do you know how long it will take altogether-having them processed by the IRS?

Print out a copy of the form 1040 et al.. (that you should keep for your personal records anyways) and simply send them a copy of the that....

Are you sure it is specifically requesting transcripts? Or does it say tax returns OR transcripts.....

my guess is that transcripts are the better part of a month away.... however, i do not know for sure....

PS... While US taxes are complex the filing procedure is not. Your USC hubby should know what a Form 1040 is.

Right, send the 1040 and all supporting schedules and documents, including W2's and 1099's. If you have an RFE, you don't have time for transcripts. However you filed electronically will allow you to print a copy. Just add the W2's and/or 1099's and send a signed copy of it.

I think "transcripts" may be their way of saying tax returns. It's a fancy word for papers. It doesn't sound professional to ask for "tax papers", so they request "tax transcripts" which would mean "tax return" or the actual tax transcripts. That's my opinion.

Anyway, regrading filing taxes electronically. I do a lot them each year, and I can tell you that the IRS accepts a tax return electronically in 12-36 hours usually. What that means is that there are no glaring problems with it. It's kind of like getting an NOA1. They don't reject it for missing DOB or SS#, and then they go to work on it. Luckily for you the IRS timelines are a bit quicker than the CIS timelines. :P

I don't know when they exactly finish processing a return. I would guess it takes 3-5 business days. That's just an educated guess. But I don't know how long after it's processed would transcripts be available. All I know for sure is that the IRS always does refunds on Fridays, so your husband's return will be processed by next Friday whether he's due a refund or owes money. If I had to guess, I'd say it will be processed by Friday of this week. I would call them late this week and ask if it has been processed yet and if you can order transcripts, if you really want to send them instead of the copies of the 1040, any 1099's, and W-2.

That means the 1040, schedules A,B, etc (if any), all 1099's, and W-2 (or income statement).

If you send the tax transcript (which you can order from the IRS---except that in your case, as noted, there would be a wait for it since they've likely not yet processed anything), you do not need to include copies of the W2, 1099s, or schedules filed along with the return. If you send a copy of the tax return he filled out when he filed, then you do need to send those things. So it means that you can send EITHER a tax transcript OR copies of everything he sent to the IRS when he filed. Okay, he filed electronically, which is something I've never done, but I would assume that if he has to file Schedule A, B, or D, or whatever with his return, that would be available to print the same way the 1040 (or 1040 A or 1040 EZ) is. Print that out and also send photocopies of any 1099 forms he got for interest/dividend/investment type income as well as his W2. It could be worded better, but that is what they want.

but I am just curious did you also send in 2 or 3 years of previous transcripts? letter from employer, bank, pay stubs etc...?

im getting my taxes done right now so just in case i need to send in the 07 transcript i can, but curious if sending extra stuff takes care of this issue? probably every situation is different...

Yes we did send them everything we had, all the info from 2006 and 2005. And also 4868- extension, but they wanted us to send the 2007 taxes so we actually needed to file them...

Every situation is different so just hold on there and wait...

Hi,

I have a similar question as I am getting ready to file the I-864. As I understand it, you need to submit either

1) tax transcripts (ordered from IRS)

or

2) photocopies of tax returns together with copies of W2's and 1099's

My problem is that I have not filed tax returns for the past two years (I was working abroad and too lazy...) I plan on doing that within the next couple weeks. I would like to photocopy the returns I send in but the other problem I have is that I have no w2's since I worked in Germany. I do have 1099's.

Do you think I will be OK if I submit the following:

photocopies of last three years tax returns

photocopies of last three years 1099

photocopies of German version of W2 (although I would rather not since they might ask it to be translated)

last 3 pay stubs

proof of current employment (letter from employment)

offer letter from current employer confirming current salary

Any comments would be appreciated.

Hey Guys,

I'm super stressed out here and only finding NOW that other ppl are getting RFE's for taxes like me. :s

So they sent me the RFE on July 24th and gave me 87 days. It's Oct. 7th. My 87 days are almost up.

My mother in law was in charge of doing the taxes b/c my husband owns a business with his parents. She messed it up back in August, left for a month and is still taking her sweet time with stuff. She knows it's important to get it done, but she's taking forever.

My husband gave a copy of the RFE to the CPA and says that she'll handle the paperwork I need. Any of you guys know what's the number to call to extend it? I tried calling the 1-800 number listed on the RFE, but I get stuck in automated HELL and can't seem to talk to anyone.

I'm really freaking out here...
