Hi guys! Im new to this forum and about to file a petition for my parents this week. My case is "almost" straight-forward except that my father have no birth record with NSO. So I asked my father to get an affidavit from 2 people and school record which now I have in my possesion. I am now assembling the application and wondering if I should send the above mention documents even though it is not part of the checklist they have on USCIS website. I know that USCIS will check with NSO about my father's record, I just dont know when. will it be when the petition is with the service center? or with NVC? or with US embassy in Manila?

I would really appreciate any type of input you guys can give me.

How do you know the USCIS will contact NSO? Are you certain of this?

FWIW, the USCIS is only involved with the petition... Once approved it moves to the Department of State (NVC & Embassy). If the USCIS was to contact the NSO it would occur only during the petition phase.

If it were me I would only submit evidence that was required... In addition, I would not go to great lengths to create evidence that was not required.

hi, i know that u can get a birth certificate for your father.. if that's your concern..

you can have your father as "late registered" at NSO so he can have a BC..

i know some people who did that.. you can contact NSO for that.. ;)

the USCIS is very strict with the pre-screeening process. if they require yo to have the BC, you should give them the BC, otherwise you will get an RFE which will delay the process of your petition. envy_me was right have your dad go to the LCRO in your locality and register BC late registration. he will get his BC (if all documents are complete) within 10working days.

hi! Im also in the process of petetioning my parents. You can get a birth certificate of your father, marked as delayed registration. Thats what we did, my father went to the Office of Civil Registrar where he was born (Pampanga) and request for a birth certificate, and we got it after 2 weeks or so.

ok i see that you guys are petitioning parents from the philippines. i am planning to do this in the next few months. please please tell me what you submitted first??? and where are you in the whole process?? it seems so overwhelming. i was under the impression that i would just need to send the application form, fee and my BC which shows my mom as my mom hahaha. am i wrong?

We have the same case. My mother who I am about to petition once I become a USC don't have a birth record in NSO. According to the USCIS website, if you cannot get a BC from NSO, Original BC from the LCR and a statement from NSO that you don't have a NSO Birth record(P120.00) is ok with the USCIS people. Then he needs that too when he does the interview at the embassy. So tell your dad to go to NSO with the original BC and get it authenticated and ask for the statement of no record og BC. Does your father have passport?

Unobtainable birth certificates

The applicant’s birth record may not be obtainable. Some reasons are listed below:

The applicant’s birth was never officially recorded.

The applicant’s birth records have been destroyed.

The appropriate government authority will not issue one.

Please obtain a certified statement from the appropriate government authority stating the reason the applicant’s birth record is not available. With the certified statement the applicant must submit secondary evidence. For example:

A baptismal certificate that contains the date and place of birth, as well as both parents names (providing the baptism took place shortly after birth)

An adoption decree for an adopted child

An affidavit from a close relative, preferably the applicant’s mother, stating the date and place of birth, both parents names, and the mother’s maiden name.

Note: An affidavit must be executed before an official authorized to take oaths or affirmations. More specific information is available from the NVC.

i don't think affidavit of 2 persons and school records will be accepted by NVC... you might get an rfe... call nvc to clarify if you really want to submit that....

my mom also didn't have a birth record with NSO, so she went to the local office where she was born and obtained a certified copy that such birth(her birth) occurred on such dates and to such parents...she had it forwarded to NSO... and then she obtain a copy of that forwarded certified info from NSO and that's what we submitted with her DS230... embassy accepted it... never got a rfe for it...she now has her green card...

make sure you obtain two copies of that from NSO.... who knows when you will need that.... my mom only got one copy, the one we submitted with her ds230... i asked her to get another one from NSO, just in case the consul would ask for one or for some reason they have lost the one we submitted...NSO said they don't have her info anymore...so she had to do the whole certified thing again from local office... fortunately, the consul didn't ask for another copy....

i think it's the local civil registrar who forwarded it to NSO on her request... i think that's what others said here as late registration...

I'm going to petition for my Mom in the Philippines but my birth certificate has an error which is the birth order. I'm afraid that this will affect my petition.

Does anyone has the same experience?

Don't you think the birth order error can take affect my petition?

Do I need to get this corrected before I can petition my Mom?
