My AOS cover letter and contents

Hi everyone, i am looking to send off my AOS (from VWP) package as soon as possible. I have written my cover letter which includes the contents of what i am sending. I know VJ has a list on a webpage, i already have it bookmarked, but if someone or more of you would be willing to look through my list and comment it would make me feel a lot more at ease.

Dear USCIS,

I hereby apply to become a Legal Permanent Resident (LPR) by the way of Adjustment of Status (AOS.) My eligibility is based on my immediate relative (spouse) My marriage took place on 08/08/2008 and I file this application with a concurrent I-130 filing.

Please find enclosed the following:

• FILING FEE $1365 AS PER PERSONAL CHECK.

I-130 CONTENTS

# I-130 Petition for Alien Relative. (completed by my Wife.)

# G-325A form for Petitioner, <WIFE'S NAME> (USC)

# Passport type photo of my wife, <Wife's name>, (USC)

# G-325A form for Alien Relative, <MY NAME>, (Alien)

# Passport type photo of myself, <My name>, (Alien)

# Copy of my Wife’s Birth Certificate (Wife's name)

# Copy of my Birth Certificate (My name)

# Copy of Marriage Certificate.

# Copy of my Wife’s Passport. (USC)

# Copy of my passport (Alien)

-Proof of Bona Fide Marriage-

# Copy of our joint bank account statement

# Copy of Alien’s Medical Bill, (Not associated with USCIS with proof of address)

# Copy of letter received from England, with postage label providing evidence of my residence in the U.S

# Numerous photographs to including wedding photos, vacations, family and event photos. (Both in the USA and UK)

# Affidavits of Support written by friends and family

# Photocopies of some of the wedding cards received

# Copy of Alien’s I-693 Medical Bill

I-485 CONTENTS

# Form I-485 Application To Register Permanent Residence or Adjust Status

# G-325a form for Applicant, <MY NAME>.

# 2 Passport type photos of applicant. (Sealed and labeled.)

# Copy of applicant’s birth certificate.

# Copy of applicant’s passport.

# Copy of Marriage Certificate

# Copy of Applicant’s Form I-94, Nonimmigrant Arrival/Departure Record. (Front and back)

# I-864 Affidavit of Support and I-864a, Contract between Sponsor and Household Member (and required evidence in tax returns and W-2 forms for both.)

# I-765 Application for Employment Authorization and supporting documents: (Birth Certificate, 2 Passport type photos and a copy of Applicant’s passport)

# I-693 Medical Examination

Also I am wondering whether or not to include my situation as a big reason for our deciding to stay here in the U.S and be together spontaneously was decided over the sad passing of my wife's father just over a month ago, or do i save this for the AOS interview?

As for the explanation, a single page (not too verbose) explanation is fine. Other people have done it, it doesn't hurt. Might even help.

A single page meaning a whole A4 sheet typed up explanation, or just a paragraph explaining mainly why we chose to get married spontaneously... the biggest reason being the death? Just dont want to write too little or too much and piss off the USCIS!

First off - make two separate checks: $355 for I-130 and $1,010 for AOS. IMO it's safer than have the pack rejected because some idiot does not recognize the fee.

Therein lies your problem - too little, too much? Either way, it raises questions. IMO, don't give them reason to question your case. If it comes up at the interview, it's easier to explain in person to the IO. If it doesn't (and it not always does), you're through. The explanation is not a required piece of evidence to adjust status. If they need more info, they'll ask.

Keep it short. Just a paragraph or two.

I am leaning towards not including that on my cover letter. They can ask at the interview. As for the checks, one for $1010 and one for $355, both in a ziploc bag. Sound good?

Now i have been advised to send this package off without my medical because i will be out of status in 2 days... in the hope that the USCIS will just send an RFE for it. An attorney told me this. But honestly, what do you all think?

What does the medical have to do with being out of status? And how would receiving an RFE for the medical help with being out of status?

As Heliosphan said, if approved for the green card, an overstay is forgiven.

Ohhh okay. well then yeah it would have made more sense if you would have gotten you're NOAs processed before your I-94 expired. but since it's gonna expire anyway before they get them why not just wait for the medical?

With Fed ex priority over night my AOS will be received tomorrow. One day before my I-94 expires.
