Hi everyone, i am looking to send off my AOS (from VWP) package as soon as possible. I have written my cover letter which includes the contents of what i am sending. I know VJ has a list on a webpage, i already have it bookmarked, but if someone or more of you would be willing to look through my list and comment it would make me feel a lot more at ease.

As for the explanation, a single page (not too verbose) explanation is fine. Other people have done it, it doesn't hurt. Might even help.

A single page meaning a whole A4 sheet typed up explanation, or just a paragraph explaining mainly why we chose to get married spontaneously... the biggest reason being the death? Just dont want to write too little or too much and piss off the USCIS!

First off - make two separate checks: $355 for I-130 and $1,010 for AOS. IMO it's safer than have the pack rejected because some idiot does not recognize the fee.

A single page meaning a whole A4 sheet typed up explanation, or just a paragraph explaining mainly why we chose to get married spontaneously... the biggest reason being the death? Just dont want to write too little or too much and piss off the USCIS!

Therein lies your problem - too little, too much? Either way, it raises questions. IMO, don't give them reason to question your case. If it comes up at the interview, it's easier to explain in person to the IO. If it doesn't (and it not always does), you're through. The explanation is not a required piece of evidence to adjust status. If they need more info, they'll ask.

Keep it short. Just a paragraph or two.

Oh yeah, the check thing that sweetpiano mention. Separate checks for I-485 and I-130. They tend to return the packet if they don't see what they want to see :wacko:

I am leaning towards not including that on my cover letter. They can ask at the interview. As for the checks, one for $1010 and one for $355, both in a ziploc bag. Sound good?

Now i have been advised to send this package off without my medical because i will be out of status in 2 days... in the hope that the USCIS will just send an RFE for it. An attorney told me this. But honestly, what do you all think?

Well you'll be out of status by the time they receive and process the NOAs so why not just send it in w/ medical instead of further delaying your case? Either way an overstay is forgiven.

BTW I used ziplock bags for my checks but I'm OCD about neatness and order (actually clinically diagnosed :lol:)

Now i have been advised to send this package off without my medical because i will be out of status in 2 days... in the hope that the USCIS will just send an RFE for it. An attorney told me this. But honestly, what do you all think?

What does the medical have to do with being out of status? And how would receiving an RFE for the medical help with being out of status? :blink:

As Heliosphan said, if approved for the green card, an overstay is forgiven.

Well you'll be out of status by the time they receive and process the NOAs so why not just send it in w/ medical instead of further delaying your case? Either way an overstay is forgiven.

It was from a member of another boards who is a well known qualified Immigration Lawyer, saying that with a recent case that changed everything about adjusting on the VWP, i should send it now and wait for an RFE.

Well you'll be out of status by the time they receive and process the NOAs so why not just send it in w/ medical instead of further delaying your case? Either way an overstay is forgiven.

It was from a member of another boards who is a well known qualified Immigration Lawyer, saying that with a recent case that changed everything about adjusting on the VWP, i should send it now and wait for an RFE.

Ohhh okay. well then yeah it would have made more sense if you would have gotten you're NOAs processed before your I-94 expired. but since it's gonna expire anyway before they get them why not just wait for the medical?

November 6 2008 (Day 177) - I-485s and I-130s TOUCHED

November 19 2008 (Day 190) - Had interview, APPROVED! Interview took less than 10 minutes

December 5 2008 (Day 206) - GREEN CARDS ARRIVE!!

The rest of your checklist looks good. Are you not applying for EAD?

As for the checks, one for $1010 and one for $355, both in a ziploc bag. Sound good?

Each check paper-clipped to their respective application. Good luck!

My EAD application is in there, under the I-485 contents. I hope this is correct.

Now i have been advised to send this package off without my medical because i will be out of status in 2 days... in the hope that the USCIS will just send an RFE for it. An attorney told me this. But honestly, what do you all think?

Well you'll be out of status by the time they receive and process the NOAs so why not just send it in w/ medical instead of further delaying your case? Either way an overstay is forgiven.

With Fed ex priority over night my AOS will be received tomorrow. One day before my I-94 expires.

11/04/2008 -- EAD CARD PRODUCTION ORDERED! Thank you Lord.

11/10/2008 -- EAD card received in the mail! wOOt wOOt!!!!

11/12/2008 -- SSN ordered from Hackensack, 2-4 weeks in mail!

11/28/2008 -- SSN Received in the mail, wOOt!!!!!!!!

12/7/2008 -- INTERVIEW LETTER RECEIVED!!! It's scheduled February 19, 2009 at 8:30am in Newark. *nerves*

2/19/2009 -- Interview 8:30am - Green Card verbally approved

2/23/2009 -- Welcome letter received! followed by I-130 approval notice!
