Just trying to clarify a few questions regarding my wife’s AOS/ Adjustment of Status paper work packet, post marriage. One question I am not sure about..? Do I need to send in a form I-130/Petition for Alien Relative if we were married here/U.S.A. while she was legally here on a tourist visa. (Yes I know all about the fraud of that. But in my case circumstances changed for both of us, we/she did not know at the time she arrived that we would get married, nothing illegal about that.) Anyway my understanding is we just need to file the I-485, I-864, I-693, I-765, (and the I-131 if she wants to.) Just trying to make sure I am correct about that. From my understanding the I-130 would have been required should I have filed for the K-1 or K-3 visa…?

She has a valid One year visa to stay here. Also on the medical form what are the vaccination requirements? And since her vaccination records are in her home country retrieving them now is next to impossible. Hoping she does not have to get every vaccine under the sun to satisfy all the requirements..! Anyway would appreciate any feedback or advice for these circumstances.

You have it backwards. Yes, you'll need to file an I-130. K1, is the process that skips the I-130.

It won't actually matter, but just for clarity, which has a validity of one year, the visa or the I-94?

She will either need to get those records to prove she already had the vaccines or get all the vaccines all over again. I think there's a way they can test to see which vaccines she already had.

One thing to clarify: The visa is valid to remain in the US for the period it was granted at the POE. Check the passport and see the stamp until when its valid. (dont loose the I-94) Doesn't matter how long the visa is for. Visa stays are granted from 1 month to 6 months maximum.

The vaccinations: there is a new requirement. Check the USCIS for the latest vaccination requirements. If she doesn't have the records at hand she will need to be vaccinated again plus the TB exam and blood test.

You MUST file the I-130 otherwise its impossible for her to stay here.

It depends from city and civil surgeon. Price goes from $150-$560. Like I said it depends, the civil surgeon I saw cost me $200 plus $24 (blood test) but that was me cause I brought my vaccination record with me. If not they would have charged me $395.

There is a new requirement that came into place during August were a number of new vaccines are required by the USCIS.

Vaccinations can be done anywhere... the examination however must be done by a civil surgeon.... It might be easiest to have it all done in one office but it does not need to be done that way...
