well, we know a person with a nvc complete date fromt he end of September doesn't have a date yet either (but we dont know about January dates yet). If I get a January date it will have been a 3 month wait...Im praying hard!!!

Nicole, since nobody in the world can probably tell you what the US will do, wouldn't it make more sense for you to continue with the process to *see* if he does indeed have a ban? Yes, you could lose money, but wouldn't it be a worthwhile investment? It seems to me getting a definitive answer from the US government would be a stronger answer than any lawyer could give you.

You're so close, just go for it.

The alternative plan sounds fine -- do you have to do anything to move to Mexico?

But finish this process. What's the worst thing they can say? No, right?

Or is there some additional punishment that could occur for trying and being turned down?

If we continue and we are denied for 10 years, we have to file a whole new I-130 and everything and who knows how long they will take to process at that time. At least if we hold off where we are now, the wait should only be a few months from when we start it up again.

Another thing to keep in mind though, Nicole, is that even if/when your husband is denied and banned, since you would be living in Mexico with him, you would qualify for direct consular filing...which is waaaaay quicker than going through USCIS/NVC. Either way though you would have to refile from scratch anyway. Someone correct me if I'm wrong, but I'm 95% sure that all approved petitions (including I-130s) require you to pursue them within a certain amount of time before it is cancelled...and I'm sure 10 years would be over that mark. :(

CHD is correct. You can't just put your case on hold. If there is no action within a certain period (I believe it's a year) your petition will be terminated.

If you really can't find a decent lawyer, PM me and I'll give you the names of 2 immigration attorneys I actually would trust to give out their names.

Me...screwed up my right shoulder. Tore my rotator cuff in a freak Ninja training accident. It's a long story....so we'll leave it at that.

Guess how I got to spend my holiday (celebrating the attempted genocide of indigenous Americans by the colonists):

A. In pain caused by a torn rotator cuff

B. In a near coma because of the strong narcotic pain killers and muscle relaxers

C. Playing Wii Bowling at the neighbors house with their 90 year old grandmother

D. All of the above.

If you selected "D" you're absolutely correct. My day consisted of all of the above...not to mention missing Ring Ring,

and hoping that I'll have recovered enough to carry her luggage when she comes to visit in 10 days.

I'm sure a lotta of you thought I'd forgotten about VJ (and probably a lot more didn't even notice I was gone).

But that's my excuse...and now I'm back.

Mimche is doing well. I am still in state of shock. I mean we both are.... This is awesome. Now I understand it better. This is THE best thing I could possibly ever have in my life.

You are correct about that... partially... I can keep in contact with NVC and our case will stay active as long as there is contact every year. I plan on moving for the moment and I will look for a good attorney to help us... if they think that we should move on, then I will move forward with the case. I am out thousands of dollars already from this so I don't want to spend it all over again until I hear good sound advice from an experienced attorney. This has been a very difficult decision to make, and I appreciate all your thoughts and concerns, it truely means the world to me. No one in my family of circle of friends have any idea what kind of toll this takes on you, so it is always nice to come here and share and vent.

Hey Rajaa....used games work just as well as new ones. :-)

If your boys (10 year old and hubby) really get hooked, you might want to look into getting a "chip" for the Wii.

We have 2 of them at home...Japanese (with chip) and American.

Wii Fit is a great workout. Wii bowling and tennis are just plain good fun for all.

Nimche, I can only imagine the joy you're experiencing. WOW!!!!

4 years of waiting, and now...together at last. THAT is true magic sir.

Nicole, stop worrying about money. You can make money, and spend it or lose it. If you work hard, you can make that money back.

TIME....once it's lost, you can never get it back. Only you know what's the right step forward, but please don't value money over time.

I just heard about a guy I didn't even know, but lots of my friends knew....he was 43 years old. Had a blood clot in his leg, it moved to his heart,

he died in his sleep. Time is the most precious of all things in life.

I'm not very religious, but very spiritual. I believe that at the end of our lives, if it's for a split second or for weeks and months, we get to look back and review our lives. If you lived a good life, you get to enjoy it all over again. That's why I try to lead a good life, for now and for later.

Think about the people who lie, and cheat, and steal everyday. Think about what they get to see at the end of their days.

Here is my story. I've lived problem free life, payed my taxes. One day I decided to marry this girl. But to do so would require her to come to US of A, and so it started. My problem free live turned in to free problems from USCIS! Sure things turned to unsure, certain dates turned to aproximation within months. All logical thinking was out the door, as I filed my papers withing famous Vermont Centre!
