My curiosity knows no bounds, so I'm starting a new topic like it was suggested last night.

My fiance forgot to put a date on the personal check he sent along with our I-129F. Everything else on the check is accurate/valid.

Should we expect the whole packet to be returned (it was sent Aug 20th and received Aug 22nd), or will they cash it anyway? Here in Croatia, they wouldn't mind cashing a check with no date on it, as long as it's signed (they only wouldn't be able to cash one dated ahead of time).

Has anyone had this happen?

Interview Date: April 8th 2009, 10:30 - APPROVED!

Well I can say from personal experience that my entire packet was sent back because my check said "Four hundred and 55/100" on the written area even though the numbers said $455. That's a bit bigger of a mistake than yours but I wouldn't be surprised if yours did get sent back :(

So kind of you to start a new topic ;)

If a check does not bear a date, it is considered dated as of the time it is tendered by the drawer. (UCC 3-113).

However, as I said previously.. it is up to the discretion of those processing payment. I'm sure they have guidelines to follow but I can tell you, for instance, that Vermont will often return a check when the address of the petitioner on the check does not match the address of the petitioner that's on the form...CSC doesn't seem to care. It's a ####### shoot really. Fingers crossed for you!

Well from what Kim and Russ said, it shouldn't be too much of a worry. But mine took almost a whole week to make it back to me =_=

Oh, something like a week.. is not too bad! I still hope they'll just cash it, of course.

And.. it was cashed on the 25th. No returns, no questions asked. =)

FWIW, if I remember back to my business law days as it relates to checks... When there is a discrepancy between the "numerics" and the "written" amount, it is the written amount that takes precedence... so in your case 455.00 in the numerics versus 400.55 in the written would mandate a return for incorrect fee payment...

FWIW, if I remember back to my business law days as it relates to checks... I don't have fwaguy's background, but I did remember an ex-teller telling me that the written amount takes precedence, too.
