Hello all,

I'm an American and have been living and working in Japan (tokyo) for 5 years now. Married to a Japanese national and have a 3 year old son. Me and my family want to move back to the U.S.....I do not have a job yet in America, and^or a place to live (outside of my parents house until we got everything going)... What would the best route be....I've read that IR-1/CR-1 is probally the best, but what is the DCF or is that automatic here at the Tokyo embassy? Will I have to find a joint sponsor for my I-864? I've done all my taxes and that is all straight ^^^^ I'm just stuck on this domcile thing....I dont have any american bank accounts or land or anything that ties me to america, so am I up for any surprizes or is it all stright forward? thanks all...

If you do DCF- which you can as you live there and is the fastest- your wife will automatically get a IR-1 as you are married longer than 2 years, and thus a 10 year green card once in the US. Best visa to have :)

Unless your employment will continue in the USA, or you can show significant assets, you will need a US based co-sponsor. For domicile, you need to show serious intent of re-establishing domicile, such as proof you've been looking for a job (ideally a job offer) in the US, lease or buy a home or at least emails from a letting agents, valid US driving liscense etc.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Domicle is the biggy. Get an mailing address, bank account, register to vote, some credit cars. Maybe "rent" part of your parents house also.

You'll need a joint sponsor also.

I was kind of in the same place you are.

I/we opted to do it this way because of the I-864. (and that a joint sponsor would be difficult). I moved back to the U.S. got a job, lived with my parents for a few months then after a few paychecks got a place of my own, and then started the I-130 process. She has visited here since a few times, rearranged the house to her standards, (you know how that is) and all is well yet frustrating due to the immigration process.

Since we have been married for over two years the CR1 should go through smoothly and she will receive the green card for 10 years.

Just a side note. (my wife and I agree.. Don't let your wife or child give up there Japanese citizenship..) Just our opinion.

We were in the same situation.

For domicile part, we brought copies of my husband's US bank account, driver's license and payment of a shed in the US, but they didn't look at any of the documents.

All they cared was if we have a joint sponsor because my husband has to quit his current job and look for one in the US.

If you are able to get a joint sponsor, that's definitely the way to go. No need to move over to the US before her unless you simply cannot find anyone willing to help. :) The suggestions about proving domicile have been good. Make sure you put US as your domicile when it comes time to the I-864 financial form, and you can use your parents' address as your permanent US mailing address for the purpose of domicile. Do you happen to still be registered to vote at that address?

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
