This section of the SSA Program Policy Information Site contains the public version of the Program Operations Manual System (POMS). The POMS is a primary source of information used by Social Security employees to process claims for Social Security benefits. The public version of POMS is identical to the version used by Social Security employees except that it does not include internal data entry and sensitive content instructions.

Please note that this document is intended for SSA employees. It contains technical terms and instructions that will be unfamiliar to you.

I guess I can tell this story one more time. LOL At one time K-1s were also required to provide an EAD card or work stamp to be assigned a work authorized SSN. However, INS at that time was having trouble getting EAD cards out to people with K-1 status under the A6 catagory before the 90 day k-1 status was expired, which made the EAD cards worthless, so SSA changed their policy (look up the infamous EM-00154) and allowed K-1s to be assigned a work authorized SSN using the I-94.

However, immigration law has never changed. This is what controls a K-1's right to work

Sec. 274a.12 Classes of aliens authorized to accept employment.

(a) Aliens authorized employment incident to status. Pursuant to the statutory or regulatory reference cited, the following classes of aliens are authorized to be employed in the United States without restrictions as to location or type of employment as a condition of their admission or subsequent change to one of the indicated classes. Any alien who is within a class of aliens described in paragraphs (a)(3), (a)(4), (a)(6)-(a)(8), (a)(10)-(a)(15), or (a)(20) of this section, and who seeks to be employed in the United States, must apply to U.S.Citizenship and Immigration Services (USCIS) for a document evidencing such employment authorization. USCIS may, in its discretion, determine the validity period assigned to any document issued evidencing an alien's authorization to work in the United States.

(6) An alien admitted to the United States as a nonimmigrant fiancé or fiancee pursuant to section 101(a)(15)(K)(i) of the Act, or an alien admitted as a child of such alien, for the period of admission in that status, as evidenced by an employment authorization document issued by the Service;

Just for future reference for everybody I guess...

It is a memo from DHS to employers on what documents to look for when hiring prospective employees. Basically, it says that if you can't show any of the following, you must have EAD or un-expired I-94

• US passport (unexpired or expired)

• US birth certificate

• Permanent Resident Card (Resident Alien Card, Form I-551, and/or Alien Registration Receipt Card) also known as “Green Card”

• Unrestricted Social Security Card
