k1 peeps can work!?!

ok now im confused.. click the link above and check..

people say k1 peeps cant work without authorization/permit..

but in my understanding with this thing that ive read..

from the link above.. section C (Policy - Employment Authorization by Class of Admission) part 1 (Aliens Work Authorized Without Specific DHS Authorization)

C. Policy - Employment Authorization by Class of Admission

The following policy applies to employment authorization by class of admission:

1. Aliens Work Authorized Without Specific DHS Authorization

The following sections list nonimmigrants, by alien class of admission codes, who are authorized to work in the U.S. without specific authorization from DHS. The person’s I-94 will not have the DHS employment authorization stamp and the alien will generally not have an EAD.

For those with an asterisk (*), the principal alien, spouse, and child all have the same classification code. In some instances, both the husband and wife are both principal aliens when the classification is E-1, E-2. Accept their statements that both are principals.

For those with a double asterisk (**) (non-immigrant E-1, E-2, and L-2 classifications), the spouse is also authorized to work without specific DHS authorization. The E-1, E-2, and L-2 spouse is not required to apply to DHS for an EAD card as documentary evidence of work authorization but may choose to do so. When the E-1, E-2, or L-2 spouse applies for an SSN card and does not submit an EAD as evidence of employment authorization, he/she must submit, in addition to evidence of immigration status, evidence of a marital relationship to the principal E-1, E-2, or L-1 alien. The evidence of marital relationship between the applicant and the principal E-1, E-2, or L-1 alien is a marriage document (indicating the marriage occurred prior to admission to the U.S. as an E-1, E-2, or L-2 non-immigrant).

NOTE: Ask the alien whether he/she is the principal alien who is authorized to work or the spouse, child or other dependent of the principal alien and see RM 00203.500C.1., RM 00203.500C.2., and RM 00203.500C.3. when the alien is the spouse (other than an E-1, E-2 or L-2 spouse) or child.

i would just like to add in section C, part 2 Aliens Who Require an EAD from DHS Authorizing Employment..

You got that from SSA, SSA considers K-1 work auth with or without EAD in order to issue an SSN. SSA is not the department that gives work auth DHS does. SSA will mark K-1's SSN card with "VALID FOR WORK ONLY WITH DHS AUTHORIZATION" this will indicate to an employer to request to see additional evidence of work authorization, that is EAD stamp, EAD card, Green-card etc..

NOTE: K-1 is not a work visa, it is a fiancee visa for entry to the USA and marriage, K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not.

This subject comes up often on the board.

why in the hell would they put that on their site when it's "a thing just for their workers"..

i mean people would see that and be misled by that info.. :ranting:

Correct Most states will issue a marriage license without requiring an SSN, however there are a few states that do require SSN for a marriage license, Tennessee is one that comes to mind.

it's just stupid to have an info like that on SSA site cos it's a misleading information..

and yeah, a bit bored and i really wanna work soon.. :(

I like to KISS. not without EAD or Green Card.

KISS " keep it short & simple", the other type is resrved for my wife. :P

No. Yu and Dan explained it well. As a matter of fact, this topic had ben discussed or/and debated here over and over before.

I know how eager most people are to work right away but it aint gonna change the rules. To put it in a nutshell, the beneficiary isnt really "fully" or "technically", or however you might wanna put it, legal until that beneficiary marries the petitioning USC.

That marriage could be in the Philippines or US, it doesnt really matter. If you marry in the PI then you can work right away as soon as you land here. If you come here as K1, then the first order of business is really/should be.... your relationship to the petitioner and not finding jobs.

For lack of better words... K1s are conditional until you're married to their USC fiances. Only then you can adjust status and apply for "Employment Authorization Document".

we all know k1 is a fiance/e visa..

the thing is the SSA site has misleading info..

if u would read it carefully, it says k1 can work..

but oh well, as everybody said k1 CANT work.. :(
