Hello,new here and have been trying to understand the processes.But some things arent really clear.We married September 2005 and reside in the UK,but would like to move to the US. Wife is a US citizen.We've started the process with the police report and filling out the I130.First question is sponsorship.Have read inlaws cant sponsor but then also read they prefer inlaws,can anyone clearify?And as we are both working here how will that affect financial side of things. We dont have many assets to rely on.Her family is happy to sponsor and provide a place to live until we settle and get jobs there.Any advice would be greatly appreciatedThank you!

Hello, check out the DCF guide pinned at the top of the forum, it's really helpful and hopefully will help you understand the process.

To give you a quick answer to one of your questions, in-laws certainly can sponsor you. I don't understand what you mean about how working in the UK will affect the 'financial side of things'?

You need to talk to London Consulate before yu plan to go with DCF.. They are somewhat restrictive on what they will take. Typically, the minimum is the the USC has a Indefinite Leave to Remain Stamp in their passport...

Sorry, but that is not entirely true.... I am DCF'ing in London, and I do not have indefinite leave to remain. They require a certain amount of time living in the UK, and I reckon that as each case is different, they treat somewhat individually... When me and my husband started, we had been married for only 6 months, I had been living in the UK for 2 years on a student visa, and that wasn't a problem, as they approved our I130.

If I was you, I ouwld send the papers and wait to see what they say.

Regarding your sponsor, your wife needs to be your primary sponsor, even if she can't meet the porverty lines. Then you can ask your in-laws to be co-sponsors.

as others point out, the first step is really finding out if London USCIS will accept your wife's I-130. Have you submitted it yet?

If you have not, you should. The way your case will process depends VERY much on what London tells her.

Hi,

just wanted to say thanks guys, my wife rang the embassy in London they said as she has a residents stamp even with limited leave to remain, they should be able to do it..

the financal thing was us both being here and not having a job in the US,

as for sponser well thanks for clearing that up, it reads inlaws etc can't sponser, so was alittle confusing, but as you said the wife is the main sponser they will be co-sponsers...

will send the paper work in this week, all I need after that is the police report, and vacinations.. we already have the rest...

so as soon as I send it will update...

many thanks as sometimes to much info is as confusing as very little..

My husband had his vaccinations done by our GP and it was WAYYYYYYYYYYYYYY cheaper than having them done at Knightsbridge...

Seems like it might be good news j2ames. Your wife should confirm WHO she spoke with; if it was the USCIS/DHS office which has an office in the Embassy, it's good news. If she called the pay-per-cal numberin Scotland, take it with a grain of salt.
