Hi all

Under I864 Part 4 B. Sponsors hshld size

1. no.of Persons related 2 you by birth

Now Pri has her Mom and Sis who stay with her but are not dependent on her so still i shld be putting there as 3

then that makes the total incldng me as 4 is that how it shld be or it should be only dependents

Part4 D determination of Elgblty bsd on Income

I believe i shld be Ticking the first square??

Any comments are welcome

If they r not dependent on her, she doesnt have to include them in the household size. Our co sponsor is single, never been married and he still leaves with his parents, but they dont depend on them. same with my husband: when we did the documents we wereliving at his parents but nobody depended on him, otherwise his houseld size would have been.....6! :hehe: We did an infopass and the officer said: if they dont depend on u, dont include them. Same with the co sponsor. Sfter 2 days we called immigration gaian just2 be sure we had got the right info and they told us not to include them as well. So....I guess she doesnt have to include them.

Good Luck, that document is the worst nightmare lol

maria had one experience, which has not had a result yet (no interview).

The form is very clear about who is to be counted in a household and who is not; I usually say 'go with the instructions'.

Income of household members can be included in the total income (if they agree and pri's income is insufficient for the extra bodies).

My 864 got kicked back to me b/c of this issue, which is still so murky to many people.

I did not include my sister who lives in the same house. She lives on the lower level in of my house She also happens to be our co-sponsor.

I did not include her because she and I are not dependant on each other, but because our addresses are the same, I was told I MUST include her in the household.

Timeline

In short you must include every single person living under the same roof regardless if they are dependent on the sponsor or not. We had to include my in-laws in this as well.

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

March 6th 2014 - USPS shows packet was delivered at NVC

March 10th 2014 - AOS shows as paid in the CEAC portal/AOS logged into system as being received by NVC.

March 11th 2014 - New case number assigned for my Dad.

March 20th 2014 - Paid IV fee for my Mum.

March 25th 2014 - AOS accepted by NVC with no checklist.

March 26th 2014 - Filled in and submitted DS-260 for my Mum

March 31st 2014 - AOS found in my Mum's file for my Dad - accepted and placed into his file/IV fee available for my Dad and Paid.

April 1st - Mailed all civil documents to NVC for both parents.

April 3rd: IV fee shows as paid in portal/submitted DS-260 for my Dad.

April 22nd: checklist issued for civil documents - NVC error ...

April 23rd: sent another certified copy of my marriage certificate

April 24th: Case complete! :)

April 30th 2014 - Medical scheduled for parents at Knightsbridge in London

June 11th: Interview at London Embassy - Approved :)

Read the form, read the instructions. One category of Household Member is clearly defined, over and over, as 'persons who are related by birth, marriage, or adoption who live in your residence'. Do you see anything that says, "unless ...." or "except ....."?

No, not every single person. Only persons who are related by birth, marriage, or adoption.

What you were told is incorrect. If it should ever become an issue your joint sponsor may be subject to penalty for making a material misrepresentation, and note that the USCIS giving the misinformation will be no defense.

well so i the total hsehld sixe incldng me shll be 4

Pri's Income is $41200 p/a i believe the 2006 requirement for 125% above poverty is $25000 for 4 hshld size

so still i am good
