i would like to ask something about the AOS, SSN and EAD

I went here in the US under K1 and got married last month without applying for SSN and EAD.

Last week we went to SSN Office to get number but they said i cannot get one till i present them a document from HomeLand Security allowing me to get SSN. Because i am no longer under K1 and, K3 now because i am already married.

All i want for now is to get an EAD and SSN since AOS will take longer.

Or do i really need to wait for 6 months or so to get the AOS with EAD for me to get the SSN?

It is really confusing. Please advise me on what to do.

That's a bunch of #######. Your status is K-1 until you are out of status or you're AOS pending, but never K-3. I would go back and ask for a supervisor. In the GUIDES section, there is a document you should print and bring with you when you go. It clearly shows that K-1's (you ARE a K-1 still) are eligible for a SSN. The person you dealt with is obviously misinformed as to what the rules are. This is very typical of these types of civil service employees. Most of them have mastered the art of sleeping with their eyes open at work. They may look normal, but their brains are actually in atrophy from lack of use.

My wife and I went AFTER we were married, with our marriage certificate, and got her a card with her married name.

You do not need SSN to apply for AOS... As soon as you get your EAD you can go get a SSN.... but I agree with the other poster, you are still K-1... if you want get the SSN in your previous name and do not tell them you are married... it eliminates the confusion even though they are wrong..

hello,

Go on the web site of the SSA (agency for SSN), print the requirement list, and go with it and all your papers.

My husband and me, we do like that.

If the agent disagrees with the printings, we ask for a supervisor.

Well just yesterday I applied for SSN and I went through the whole thing without any questioned whatsoever. The girl said I should get my card after 8 days. I am in K1 and got married last month too. I just brought with me our marriage license and my passport/visa.

And point them to section C (Policy - Employment Authorization by Class of Admission) Part 1 (Aliens Work Authorized Without Specific DHS Authorization)....K1 is listed under that table (as long as your I-94 is not expiring in the next 2 weeks you should be able to get an SSN).

ETA: My husband went yesterday and was asked no questions.

Getting married does not matter, what does is how long you have been here.

How long have you been in the United States? If 76 days or over the SSA office is correct in that you need either an EAD card or I-551 stamp or card.

The problem is that 99.9% of SSA employees really don't know what a K-1 visa is, which you can't really blame them since you aren't being paid to be an expert on immigration.

RM 00203.500 C1 has

K-1 Fiancé(e) of U.S. citizen

but RM 00203.500 C2 has

K-3 Spouse of U.S. Citizen

So in their mind, hey this person is married so they can't be a fiancé(e) of U.S. citizen, and now that they are married and are the spouse of a U.S. citizen, they must be a K-3 and need an EAD card to be assigned an SSN.

To everyone here that stupid, but to someone not involved in the process it's somewhat logical.

I think you have to go back and speak with another agent because my husband and i went after our wedding and i got my card in the mail 2weeks later, we went back same day to ask for another one in my married name and they said i should wait to get it in the mail but it might take a bit longer than the first because they have to write the department of homeland security after the authorization i will get it in the mail.

I even got a state id for identification so that i stop carrying my passport around because i almost lost it in the mall.

The drivers license agent said he needed to check if i could get it in my married name and yes i did. The only flaw is that it expires on same date as I-94, but good thing is they will understand because my status is pending and i have filled AOS.

So Go back and speak with someone different, you should get it.
