How does K3 approval work -

Okay, I am confused regarding the timelines and the approval processes. I had read on this forum that the K3 approvals are based on I-130 filing order, yet I see on the timeline statistics (the chart etc.) that VSC is processing June 6, 08 K3 applications while March for I-130. Can someone please explain:

A K-3 is based on the I-129F. An IR1/CR1 is based on the I-130.

Because K-3s require both the I-130 and the I-129F, it is possible that the I-130 will be adjudicated first and sent on to NVC. That would turn the K-3 into an IR1/CR1. Sometimes they're both processed and it is a race to see who finishes first. And sometimes the I-129F gets to NVC first and you're a K-3.

Right now, you're a K-3 filer. Pay attention to the I-129F dates.

If you are referring to the processing times on this website. They are wrong. If you look at the K-3 processing times here:

My belief is that the I-129F NOA1 to NOA2 graphs are switched. The graph for CSC is actually the data for VSC, and the graph for VSC is actually CSC data.

To get an accurate idea, you will need to search the timelines.

It was always my understanding that if you have filed for a K3, the NVC would hold on to the I 130 and allow the K3 to pass through first. K3 was originally designed as a way for couples to reunite quicker as the CR1/IR1 route used to actually take much longer that it does now.

Yes- you can still continue with the CR1 route. You'll have to return to your home Country for the Interview though.

If you are asking whether she can be interviewed in America for her CR1/IR1 in America, No.

In theory, your spouse can go back to her country for the CR1/IR1 interview and re-enter America with the CR1/IR1 visa. Practically, most choose to spend the $1010 adjust status instead spend it on air ticket flying home to attend the interview.
