Hi all!

We finally got the kids visa's approved (after they told us my wife's kids weren't her kids! lol)

We got their visa's approved based on my income from 2005-2006 tax returns.

Now I am in the process of filing my taxes for 2007 (I filed a six month extension).

My income for 2007 falls short of the requirement ($26,500 for a family of four) and I'm worried about the AoS for the kids. My wife started working in January of 2008, can her income be included for the AoS.

So to sum up, we had sufficient income '05, '06 but not in '07. Now that my wife and I are both working in '08 can we get documentation from her employer to get the AoS approved? Her income from her job, added to mine would clearly exceed the requirement.

What happens if we can't AoS the kids once they are here?!

Does it specifically have to be the 07 year that meets the requirements? I know this doesn't apply to the OP, but I figured if your current job exceeded the 125%, and you could prove you are secure in that position, then you'd be ok.

You sometimes will find the answers to your questions in the instructions to the form..

You may use the income of your spouse and/or any other relatives living in your residence if they are willing to be jointly responsible with you for the intending immigrant(s) you are sponsoring.
