R other forms of visa apps a possibility when you have filed for K-3 already???

Hi- I'm Amy, a newbie here @ VJ.. I am just wondering if anyone knows if there are other forms of visas available to perhaps get my husband here sooner than with a K-3 visa?

I have been told that there are work visas available, and school visas- but have also heard that if you apply for one of those, you could lose all chances for the K-3 to be accepted?!

My husbands living conditions have gone down quite a bit since my last trip there, esp. since he had to buy me a new plane ticket home, because I missed my flight on a non refundable-replaceable ticket, and he has been a student living on savings for the past 3-4months. Things are getting tight for him and of course I want him here YESTERDAY! I know everyone is in the same boat...

I would love ANY info you may have on another option would be greatly appreciated! I don't think I am any better or more important than anyone else, but I REALLY would like to have him here so we can start our family, and I can know he is ok.

Amy -

You can try the tourist visa option and have him wait here while the application is pending. However, the consulate is highly likely to scrutinize your hubby's application once they find out that you have already for an immigrant visa for him. There are some people who have been able to do this, but most get rejected. This applies to any other visa that your husband might try getting. You may try filing an expedite for your case and present a strong case as to why your husband should be with you.

While there are many different classes of visas.... most are non-immigrant visas. So, if your question is truly can I bring him here quicker on a different visa type (most likely a non-immigrant visa) so he can stay permanently, the answer is probably no. Bringing over you intended immigrant spouse on a non-immigrant visa with the intention of staying is a big no no....

We can all sympathize with you, I am sure....I love my husband dearly and on Oct 29 it will be our 1st year wedding anniversary and we will not be together...still. His K3 interview date is for Nov 3...so with any luck he will be here by Thanksgiving. There is no sympathy from USCIS or NVC...they hear this all the time and like you said...no one person missing a spouse is more important than the other. I am desperate for my husband at this time...and am so glad this long process is coming to a slow close for us...hopefully. Even with an interview there's no guarantee to get the visa quickly. I have seen some being held back for "administrative processing" for months on here....you can read through the older forums for an idea of what can happen. Good and bad.

Make sure you explain to your husband what he is about to go through...and you understand that yourself. Its going to be a while to get this completed. The only thing that can make it faster is if you file all of the papers properly and don't get anything wrong to cause a RFE (request for evidence) on your case......that causes major delays. After you are done processing your paperwork with the NVC and your case is completed, be prepared for a long wait there as well. The K3 is not faster....our K3 interview is scheduled but I will change it to a immigrant visa interview when the time comes if we don't have one already (for the original I-130) because all of our paperwork is done, fees paid, etc.

I called Senators and wrote letters but nothing helps...not even having an attorney. The only way this would probably be quicker is if there was a death in the family or some other emergency, then you would have to have proof and it could still take days.

If your love is strong you will survive it just fine...but you have to stay strong.

You can go over and see him anytime you want....Believe me, I know its hard...I have a job and kids and its hard for me too...that's why I haven't gone back since March. We are going crazy missing each other.....but we do the best we can with daily webcam and phone chats.

Study up on the process and get it all perfect to speed up your chances for a faster interview and hopefully a faster visa.

That was what I 1st tried as well.. I am due to give birth in 10days and we wanted my husband to be here for the birth of the baby atleast. We applied for a non-immigrant visa just so he can come and than he could go back, but when they found out that he is married to a US citizen they rejected him, no question's asked. Reason being is because they see he has strong ties here in the states and they know if they give him the visa he'd come and stay. I bet everyone has thought of getting their loved ones here the same way but the immigration officers know that what is really happening is we are trying to avoid the long wait times. I am sorry to disappoint you but most likely they will decline his visa just because hes married to you. Sorry.

SHUKRAN! To all for your comments and advise on this question- I really do feel for everyone here- what a lengthy and consuming process! Like I said before I don't think my case is any more important than anyone else we all have a long road ahead for this process to be complete!

I can't complain anymore for a while I guess as TODAY in the mail I got an approval for our I-130 that I filed in July!!! AND I received back my I-129F with a letter saying they can't process it because the I-130 is no longer pending approval. Was told this is good news so I am holding on to that as a very strong hope!

My love to all and many many thanks for all your responses to my question- guess we'll just wait for the process to play itself out! --Amy
