i want to try to find some people who went already through this process, went to the interview and through the POE with their child. i want to know, if eighter at the interview or at the immigration they asked u for more then only the divorce paper, if any, where it was written that u got SOUL CUSTODY. as far i know, if u can proove this, there s nothing else u have to show or poove, right? what where ur experienses? please, i would appreciate it very much! thanks!

My wife Marina had papers from Carina's father (notarized with all the seals) but no one has asked her for anything at all at the K-1 Interview, POE-Chicago, or AOS interview.

I think you should have papers if possible of course "just in case" but if you don't have them then you should be ok at least based on our experience.

See an immigration attorney if you think this may be an issue though.

I dont have any experience with K2s. But I would think that if the embassy approved the K2 visa, then you should've had all your paperwork in order to bring your child to the US, including agreement from the father, or if you have a legal document where you were granted sole custody then that should be it.

My advise is to try an immigration attorney. Just in case.

Sole Custody of a child doesn't mean that you can remove a child from the country they were born in and bring them to the US if the father pays child support or has access. (visitation rights)

You need a notorized letter of concent, or a court order if the father disagrees with the child's removal.

I had to go the court order way, because my daughter's father was 100% against it even though I had sole custody.

7 months later and debt up to my eyeballs, it was the best thing I ever did.

in my case US consulate and POE did not ask any custody papers for my son

They asked for mine at K-1 interview in Montreal, POE in Lewiston, NY, and my AOS interview.

We had no problems. I don't even think my wife's divorce decree made a 'major' mention of custody of the child. Son was at the interview with my wife and they loved him... They're here now so ..

You know, I think so much of this depends on where the child is coming from, embassy employees understanding of the local culture etc... As far as I know, there are NO ABSOLUTES.

Then again there are no guarantees either!

My son calls me 'Dad'.

That's good enough for me and I'm truly honored and enjoy every minute of it.

I would deffo go thru proper channels...not just for immi, but to do the right thing.

The US Embassy in London told me this when I inquired a few months ago:

You will require a court order to show you have permission to take your child out of the United Kingdom to reside in the United States. In lieu of this document from the courts you will require a sworn statement from your ex-husband stating that he grants his permission.

As her father had no objection, he went and got a notarized statement from a Public notary (cost me £60) which I will take to the interview.

I entered the US on a K1 with my daughter on a K2 in December 2005 and before we went for the interview in Montreal I had to have a notorized permission letter from the father. I believe that it states in the package from the montreal consulate exactly what you need to have before the interview. (the Checklist) No one ever asked any questions about it but I did have it included with my massive amount of paperwork. If your childs father is OK with you taking the child you will be fine if not then you may need some legal advice.
