Cr1 and K-3 Question...

I know for the K-3, Adjustment of Status, you have to stay in the US for 2 years...is this also true for the CR-1? Kind of a bummer...we don't necessarily want to live in the US for 2 years, we just wanted a visa so we could live there for a while but more than that, could travel freely back and forth between belize and the US (for family events, and knew they would not give us tourist visas).

if you dont want the visa why apply for one? CR1 and K-3 allow you to travel.

None of the above is true (except the part about you not wanting to be stuck in the US! :) )

A K-3 visa holder may use it to enter/re-enter the US as many times as they like in the 2-year period given at the first entry. No restriction there.

If a K-3 files for AOS, they may still travel as much as they like up to the point that the K-3 visa expires. After that, they need Advance Parole to travel out of the US and return. No restriction except the application fee (IF the person has let it go so long that they need AP, this is fairly rare).

Immigrant visas (CR-1) may also travel and re-enter the US with just that visa. No restriction there.

Maybe check again on some of the stuff you know. :)

I wouldnt go on a tourist visa If I were u. Advance Parole costs money and it takes time to be approved. If I were u, I'd apply for a visa (either K3 or CR1), Its better than being stuck in the US on a tourist visa lol

one thing to note on the K3 and CR1 however is that if you stay out of the US for several months at a time, they can and will revoke your visa.

I think this may be the OPs concern.

Reba,

It may be the OP's concern, but it is not necessarily true.

Especially in the case of a CR1 immigrant visa, which is a 1-entry visa and becomes moot as a visa upon use.

John,

It's the immigrant visa that becomes moot once the holder has used it and been admitted.

Your K3 visa is a different situation and will remain very important to you since you'll be doing all that travelling.
