Ooooh the joys of just patiently waiting! How often can I actual come home to Canada and go back to the U.S. to visit my hubby?

Has anyone ever decided to for-go to the whole K3 visa and stay in the U.S. to do AOS?

OR....

Has anyone ever attempted to find a job while the K3 is processing....obtained an H1B? Is that legal?

Sometimes I wish I would've done this differently, but I guess there's not much you can do!

Hi there,

I traveled back and forth to canada while I waited for my k-3 to be processed. You might have a hard time at the border and you might not. It's all depends on the officer you get on that day that you cross. If you take along evidence that you plan on returning back to Canada and are just visiting the u.s. for a short visit...they might let you go in or they might not. I got pulled over once and was drilled and other times they just told me not to stay longer than 6 months. Just don't lie when you cross over. That is the only advice I have for you. I also think it is against the law to go into the u.s. and apply for AOS with that intend in mind. If you went into the u.s. for other reasons and then met your spouse and got married and then decided to stay and not return.... then your intend was not to stay when you left Canada. It's all about your INTENT. ONce you start one application I don't think you can abandon it and try another application so decide which way you want to go and stick with it. I went the k-3 way and kept visiting the u.s. till I got my k-3 visa approved. I hope this helps you.

03-29-08 - picked up police search results (came up negative....which is good)

04-04-08 - picked up medial results from doctor's office - xrays of my chest and sealed envelope

13-04-08 - going to Montreal by car with my girlfriend-staying at hotel across from embassy, staying for 2 nights

04-14-08 - INTERVIEW DATE - Approved

04-16-08 - Rec'd passport back from embassy

04-21-08 - Port of Entry - Sarnia Ontario

EAD

05-02-08 - Sent I-765 to California

05-06-08 - NOA - California rec'd I-765 (work auth)

08-21-08 - Biometerics appt - took 5 minutes once we got there NOT ENOUGH SPACE TO FINISH MY JOURNEY............

If you've already sent in the petitions for the K3, you can't now forgo that and try AOS, they'd most likely deny it because you have immigrant intent upon entry to the country. Same goes pretty much for any other type of visa you'd try to apply for, you already obviously have immigrant intent, so they'd be denied.

H1B would be pretty much out of reach, seein' as they're all gone for this year and you won't be able to even submit an application for one until next April, and if approved, it wouldn't be valid until October (or something like that). H1Bs are quota'd visas, and they go quickly. Unless you have a masters degree from a US university and you're going to work at a US university, you would be exempt from the quotas.
