Hi!

Our marriage date is 13 August 2006.And today is 22 August 2008.

Our case is in islamabad embassy and i m waiting the I 864 & I864A from my wife to send the embassy.

Guys plz tell me when i will get my visa so will they give me CR1 or IR1?

and second question is that is this require to notarized the I 864 & I 864A?

Sibtain, I thing you can go for CR1. Call the US embassy in Islamabad or shoot them an email. The CO has the authority to change a IR-1 to CR-1 that is my understanding.

I-864 and I864A do not need to be notarized.

The CR1 or IR1 is determined at the POE when you get to the US based on your date of marriage. Good luck!

You will get an IR-1 visa. If you've been married 2 years or more on the day of your interview, you will receive an Immediate Relative (IR-1) visa. If it has been less than 2 years, you will receive a Conditional Resident (CR-1) visa.

Regardless of which visa is issued at the interview, if you've been married 2 years or more on the day you enter the US, you will receive a 10 year greencard. Less than two years will result in a 2 year conditional greencard.

I'd correct this by stating that you *should* get an IR1 but there have been cases where a CR1 was given by mistake. So don't be afraid to ask questions if they offer the wrong visa.

You could be married for a year and a half then have your interview, but enter the US after you have been married 2 years . At that time you would receive an IR1.

There's IR1 status and then there's the IR1 visa. You are entitled to either or both depending on how long you've been married at interview or at POE. The visa "should" be IR1 if married two years at issue, and the status should be IR1 if married two years at POE, even if the visa is CR1.

If the Consulate issues the wrong visa, I wouldn't worry about it. Just make sure the POE gets it right. You use the visa only once but the green card needs to be right.

Facts are cheap...knowing how to use them is precious...

They should give you IR-1 because you are marriage over 2 years from POE.. I would make sure and send an email to Embassy to make sure. I have seen where IR-1 was not issued and they had problems later trying to change the error.
